Washington State Nonprofit Files Lawsuit Saying Fox News Misled Viewers About Coronavirus

A little-known Washington nonprofit has filed a lawsuit against Fox News in King County Superior Court, claiming the news station, its parent companies and owners violated the state’s Consumer Protection Act and acted in bad faith by disseminating false information about the novel coronavirus through its television news broadcasts and minimized the danger posed by the virus as COVID-19 began to explode into a pandemic.

The suit, filed on behalf of the Washington League for Increased Transparency and Ethics (WASHLITE), alleges Fox News engaged in unfair or deceptive acts by representing the coronavirus as a hoax in broadcasts that aired in February and March. Those broadcasts caused viewers to fail to adequately protect themselves or mitigate the virus’ spread, and therefore contributed to the public-health crisis and preventable mass death, the lawsuit says.

WASHLITE was incorporated in September 2017 by an Onalaska, Lewis County, man, according to the Secretary of State’s website, but the nonprofit does not appear to have any other web presence.

Yakima attorney Liz Hallock, who is running for governor as a Green Party candidate, is representing WASHLITE in the lawsuit against Fox News.

“We are not trying to chill free speech here. But we believe the public was endangered by false and deceptive communications in the stream of commerce,” Hallock said in phone interview Friday. “There are a lot of people who listen to Fox News, and they’re not taking the recommendations of public-health officials seriously. This is not about money; it’s about making sure the public gets the message this is not a hoax.”

According to Hallock, several members of WASHLITE live in King County and one of them has COVID-19, the respiratory disease caused by the virus.

Just what you'd expect here in Washington. If this woman weren't a partisan dunce, she'd know what we know: cautious optimism about the threat posed by the CV was widespread early on, and included Fauci, the CDC, the World Health Organization, the NYT, Pelosi, Cuomo, Vox, De Blasio, and many other leftist politicians and news sources.

On the other hand, several Fox commentators - Gutfeld, Carlson, and Watters - expressed concern in January that the problem might be worse than many thought. Fox should be able to slap this down with an hour of research - actually NO research, because they've already done it.

Maybe remove it to federal court? Western District of Washington is nearly all Republican appointees, including a Nixon appointee who is 97 years old. Not sure if it would really help. So many of them “grow” while on the bench.

Oh hell yes these communists are.

This is a no lose situation for them. If Fox News loses they get to declare what’s “true” - just like they do now with a Twitter and Facebook and Google where speech has to be “responsible, factual and not hate speech or you get delisted.”

If Fox News wins, likely, then the communists fall back on their other tactic by screaming that the US courts allow Fox News to lie and claim its LEGAL and what a horrible country we live in and we should enact laws to make speech “responsible, factual and free of hate speech”

This is part and parcel of the playbook.

Filing the suit via the nonprofit protects the communists from having their personal capital raided when the nuisance lawsuit fails. “We’re just a poor non-profit sir!”

While leaving it in state court sometimes seems like a wonderful idea as cheaper and more efficient, it’s hurt me more than I’ve ever benefited, and I finally just went with a default to remove it if I could.

I’ve gotten hometowned by federal judges a few times over the years, but it is much more likely to happen in state court where the other guy has picked the jurisdiction, if not the judge.

I’d risk the 9th Circuit before I’d risk a Seattle state judge.
