For Easter, a federal judge wrote a luminous decision defending religious liberty

On Saturday, American Thinker pointed out that Democrat-run jurisdictions, at both the state and the local level, seem to be enjoying a little too much the power that a public health emergency has put into their hands. One of the examples was the order Mayor Greg Fischer issued in Louisville, Kentucky. He banned all Easter services, including drive-ins, and explicitly instructed his police department to write down the license plate numbers of people attending a drive-in Easter Sunday service.

The On Fire Christian Center sought an emergency temporary restraining order in the United States District Court for the Western District of Kentucky. Not only did Judge Justin R. Walker, a Trump appointee, issue the restraining order, he also wrote a stirring and almost poetic defense of religious liberty in America. You can read the entire 20-page decision here, but this post will highlight just a few examples of the points Judge Walker made to support his order.

FYI - this is the same judge that Trump just nominated to the DC Circuit.

Expect a battle.

But he's from Kentucky. And what McConnell wants, McConnell gets, so it's likely the wishy-washy senators will fall in line.

The best thing about this decision as it relates to “drive-in” church services is that it can also be applied to church services INSIDE a church building.

If Walmart and grocery stores can stay open with protective measures in place, then so can a church.

A judge who actually understands what “shall make no law” means.

Thanks, Your Honor.

Folks should take the time to read the decision.

Wow.

And print it out to keep in your car.

Just in case.

This judge definitely has a sense of humor. LOL.

On Holy Thursday, an American mayor criminalized the communal celebration of Easter. That sentence is one that this Court never expected to see outside the pages of a dystopian novel, or perhaps the pages of The Onion.

To this layman, that 20 page doc is a legal tour de force.

And he just gave the rest of us in states with pols channeling George III a battle plan for freeing ourselves from their tyranny.

The Resurrection is Against the Law

An excerpt from Bill Wylie-Kellermann’s classic Seasons of Faith and Conscience (1991).

The sealing of the tomb is, I believe, notoriously misunderstood. I grew up with a Sunday School notion that to seal the tomb was a matter of hefting the big stone and cementing it tight. The seal, in my mind’s eye, was something like first-century caulking–puttying up the cracks to keep the stink in. Not so. This is a legal seal. Cords would be strung across the rock and anchored at each end with clay. To move the stone would break the seal and indicate tampering.

The event conspicuously echoes the story of Daniel sealed in the den of lions. “And a stone was brought and laid upon the mouth of the den, and the king sealed it with his own signet and with the signet of his lords, that nothing might be changed concerning Daniel” (Daniel 6:18). As there, this is a legal lock on the tomb door–not air tight, but politically tight. To move the stone and break the seal is a civil crime. The resurrection is against the law.

The seal is also a recurring theme in the book of Revelation. Remember the scroll of history sealed with seven seals? Only One is worthy to break them and look upon or unveil the truth: that One is the Lamb who was slain. The seal is a claim of ownership and authority. Its meaning in Revelation is at least that God in Christ reigns sovereign over all history and in all events.

Caesar, in Pilate, on the other hand, violently disputes the claim. He has set his seal of approval on Jesus’ death, and now he guarantees it with troops. Secured by security forces. When the seal is broken in the resurrection, it stands among the signs that the power of the powers (death in all its forms) has been broken. The dominion of political authority–especially inflated, aggressive–and imperial authority has been cut to the heart.

The extra-Constitutional BLUE SLIP PROCESS Is what keeps true Constitutionalists from being appointed to District Court judgeships in states with one or more Leftist DemocRAT Senators. LINDSEY GRAHAM will NEVER do away with that DemocRAT extra-constitutional VETO power. The sooner he is replaced on the Judiciary Committee as its chairman, the better.

In the meantime,on April 11, DOJ official spokes-wo-per-daughter, Kerri Kupec tweeted:
"During this sacred week for many Americans, AG Barr is monitoring govt regulation of religious services. While social distancing policies are appropriate during this emergency, they must be applied evenhandedly & not single out religious orgs. Expect action from DOJ next week!"

"Expect"? "Action?!" "DOJ"?! "Next week"?!? Is it too early to start building some gallows?

Direct link to entire decision

Kudos to the blog for actually linking to the full text, though it would be nice if the link were at the court's website.
