Judge rejects Mike Huckabee request for Florida beach access amid coronavirus

A federal judge in Florida on Monday shot down an emergency request from former Arkansas Gov. Mike Huckabee (R) and fellow beachfront property owners to be exempted from a public health order that cut off beach access during the pandemic.

Huckabee, the father of President Trump’s former White House spokeswoman Sarah Huckabee Sanders, argued that a county ordinance blocking him from access to the Gulf of Mexico shoreline behind his estimated $3.3 million home violated his constitutional rights.

U.S. District Court Judge Roger Vinson on Monday denied the suit brought by Huckabee and more than a dozen other plaintiffs that sought an injunction against Walton County, Florida, and the local sheriff.

Florida Gov. Ron DeSantis (R) on April 1 put in place a 30-day stay-at-home order for the state, but did not close beaches. The next day, Walton County passed an ordinance that closed off beach access and made violators subject to criminal penalty until April 30.

The county said that measure was designed to address a recent uptick in the number of crowds gathering on its beaches, which threatened to spread the coronavirus.

Huckabee and other beachfront property owners sued several days later. They alleged that the county had unconstitutionally deprived them of their property without compensation, violated their due process rights and conducted unreasonable seizure of their private beach property.

Which part of the Constitution gives “States” the right to Suspend the US Constitution??? And under what Parameters??

One could make the argument that the states are not suspending the Constitution, but instead are just exercising their 10th Amendment rights.

Anyway, I’d rather these safety decisions be made at the local and state level instead at far away DC.

While I think the judge is wrong, it’s nice to see someone of influence get their rights trampled on, along with the rest of us.

What in particular, is so dangerous about the beach?
Is it impossible to keep your distance from people on sand? There’s been so many stories about keeping people away from the beach. Don’t get it.

Get this....

A local road in my area crosses a river. There’s no bridge; just a low water crossing with culverts underneath. Water only crosses the road when flooding occurs.

But since Texas has closed beaches and rivers; they also closed this road.

What the AF??

It’s a stupid Marxist class thing just motor boats in Mi. Half Whit wasn’t about to allow white people ride around in their motor boats while while her base is stuck at home in Detroit. Same with the Golf, no basketball so no Golf.

None. Neither Comrade Mayors, Comrade Governors, Comrade County Whatevers, not even the President of the United States has the authority to suspend the US Constitution under any circumstances.

I hope Huckabee appeals.

On January 31, 2011, Vinson ruled that the individual mandate provision of the PPACA violated the Constitution by regulating economic inactivity, and as the mandate is not severable the entire statute was ruled unconstitutional. Vinson allowed the law to stand while it was being appealed by the Obama administration.[13][14] Vinson later issued a stay to his January ruling, allowing implementation to proceed while its constitutionality was weighed.
