I was a kid living in Daytona Beach during the polio epidemic. The churches and movie theaters were shut down, but the beach was wide open.

Governor Mike - Thank you for taking this to court! More people need to sue.

Hopefully, he appeals this decision.

It’s a government one-size-fits-all ‘solution.’ Some out of state teens mobbed a couple beaches in urban areas and made the news... where people stuck in their homes saw it and got either scared or jealous and raised hell about it, forcing politicians to overreact and ban everyone [group punishment] from using any beach whether crowded or not, even though transmission in the high UV environment of a beach would be unlikely without French kissing.

In a sense the government already took property rights when they levied taxes on property. You and I can never truly own our own property because the government retains control over what we can and cannot do on our own property and we have to pay them whatever rent they choose.

I pay my local government $800 a month “rent” and I have to pay them fees if I do anything to “my own property”.

They arbitrarily determine what my property is worth and base taxation on that figure, but in reality they levy a set amount regardless of how much it is truly worth.

Hucklebee wanted access to his beach property probably with the idea jut he and his family would be out there. However two doors or so down from him some guy with beach property could have a large beach party with ‘many’ gathering and claim the save thing Hucklebee wants.

One could make the argument that the states are not suspending the Constitution, but instead are just exercising their 10th Amendment rights.

By Suspending the Enumerated Rights and Liberties Guaranteed and Secured by the US Constitution???

Here in Michigan, the logic runs like this:

No motorized engines are allowed on waterways.
These engines get their fuel from hydrocarbons
Burning hydrocarbons increases CO2
Increased CO2 speeds the impact of Climate Change
The virus is the result of Climate Change
So, the spread of the virus is impeded by the order.

There's nothing in the article about what exactly the judge even decided, either.

If the plaintiffs in the case were demanding immediate access to the beach, then the judge may have simply decided that the issue was not a compelling one that had to be addressed immediately through a judicial order, and that the plaintiffs could seek legal remedies and compensation from their state/local governments later.

Refile but make the Plaintiff someone who has proven to have had it and medically certified to have the antibodies. Embarrass the court and the county and make them defend the pandemic order on the face of it.
