They sued the county. That case has not been settled.

The judge denied their emergency injunction.

Two different places in this same article:

A federal judge in Florida on Monday shot down an emergency request ...

U.S. District Court Judge Roger Vinson on Monday denied the suit ...

I'm not a lawyer, but even I know these are two different things.

I'm near Pensacola in my condo overlooking the beach right now, I've been here for several days. The police presence to keep people off the beach is unreal, it's completely overboard. They've got roadblocks up all over the place, yesterday I counted five cop cars with flashing lights on at a roadblock to keep people other than residents from going to Navarre Beach. A patrol truck drives down the beach in front of my condo at least once every 15 minutes. I guess they must think coronavirus is transmitted by contact with sand.

It's really kind of silly to be honest. If the cops spent one tenth the amount of manpower fighting drugs that they're spending to keep someone from stepping on the sand then we'd have won the drug war thirty years ago. It's complete overkill.

To be fair, “we” elect the government and “we” grant them these authorities, but I no longer suffer the illusion that I “own” my house and acreage.

There is a balance. If the government stops my neighbor from turning his land next to mine into a junkyard I am happy with government. If the government stops my neighbor from changing the drainage on his property thereby flooding my property I am happy with government. I want to pay for good roads, a robust emergency services, courts, and decent public schools (most of my taxes go to schools). However, I do not want to pay for stupid programs that I disagree with on moral or religious grounds nor do I want to pay to create art on a bridge that I never travel on.

Government by its very nature is always on the precipice of tyranny because most of us (me included) recognizes that we must have some government to provide the framework of an organized and civil society, but government constantly grabs more power to tax and spend on things that are not important to satisfy their basic functions. They also spend a lot of money on things we do not find valuable or important.

Sadly, the trend in our country is for more government power and authority leading the government to increasingly try to control every aspect of our lives as authoritarians. This will always be a point of contention and I highly doubt we will ever put the genie back into the bottle.

That would be a tall task. I don’t get upset by words from an anonymous stranger. I’ll humor you. The reason I want to see someone of influence face what the rest of us face is the hope that a better situated person can bring change.

I’m an average joe, if I get a ruling from some two bit judge, I have to live with it. I don’t have a $3M home and a bunch of wealthy neighbors, along with the various political connections. Don’t misunderstand, I am not jealous, I’m doing just fine and very grateful for the position I’ve attained in life. But, if Gov. Huckabee can slap down some idiot judge, then we all win.

Article 1, section 9 US Constitution

The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

Only Congress has the Authority, but so does the President if he Declares Martial Law, then the States become under the control of the US Military with Trump in charge. Congress can Object, but that is about all they can do. States have NOTHING!!!

I have no idea if local authorities are overreacting to this crisis or not. I just don’t know. But our rights and liberties are being suspended all the time, for safety reasons.

Here’s an example. The 1A gives my friends and me the right to peaceably assemble. That absolutely includes assembling at public parks. But the park near me closes at dusk. A county cop comes by and closes the gate. This done for safety reasons. The park has no streetlights. So they don’t want folks driving around there at 2AM.

My 1A right to assemble at the park has been suspended. But I’m okay with that. I understand their reasoning.

So while I disagree with you on this issue, I hope you don’t stop complaining about it. Because the complaining stops them from doing something that really would be out of bounds.

Your municipal governments (city, town, county) have way too much power. In Canada, only the Federal government can enact criminal laws. The Provinces can enact statutory laws that have limits on the penalty (fines and imprisonment), but have no jurisdiction over coastal waters or navigable rivers, or the operation of ports. Municipalities can only enact by-laws restricting use of public places, and can only issue fines - not imprisonment. Reminds me of the Dukes of Hazzard where Roscoe and Boss Hogg would put you in jail for driving over 20 miles per hour.

Walton County passed an ordinance closing the beaches in response to COVID-19.
Judge Vinson, a Naval Academy grad, former Navy aviator and Reagan appointee denied an emergency injunction against the county ordinance.
“Vinson agreed in his ruling that, in the short term, the need to keep Walton County’s beaches clear superseded the desires of the homeowners to freely access their property.

‘The primary public interest here is you don’t put people in an area where they can be exposed to COVID-19,’ he said.”

We’re in one of those Navarre condos - at one point they had yellow police tape stretched across the boardwalk stairs. We call the roadblock Checkpoint Charlie.

how far will the states go in implementing crowd control when the people decide to take matters into their own hands. Does the abuse of our freedoms need to be taken to such extremes?
Many stories are surfacing. This needs to end very soon.

Article 1, section 9 is not a suspension of the US Constitution - it is part of the US Constitution.

As far as the situation today, I haven't heard that Martial Law has been declared.
