Fear of lawsuits holding the economy back: Why open your business back up if you're immediately going to get sued when someone gets sick?

Last week, I spoke with a community college administrator.  I asked him a couple of questions:

First, when do you want to re-open the campus?  He said the sooner, the better.

Second, are you afraid of lawsuits?  Darn right, he said.  Then he added that many colleges are scared to death of a class action lawsuit.

My guess is that a lot of businessmen and school administrators know exactly what my friend was saying.

This is why we need litigation protection, as this editorial from the Las Vegas Review-Journal is indicating:

As states lift their coronavirus lockdowns, businesses face a host of obstacles, including reluctant customers, cautious workers and disrupted supply chains.  But there's another gremlin lurking in the shadows that has gone largely unnoticed: the trial lawyers.

"Plaintiffs lawyers are massing to loot medical providers and employers in response to the coronavirus," read a headline in The Wall Street Journal last month.

The issue is nationwide.  In Nevada, Randi Thompson, state director for the National Federation of Independent Businesses, told the Review-Journal that business owners worry they will be held liable if an employee contracts COVID-19 upon returning to work.  The federation conducted a poll which found that 68 percent of small business owners are very or moderately concerned about prospective lawsuits related to the virus.

Congress needs to pass legislation that protects employers and school districts from lawsuit madness. Otherwise, important sectors of the economy may not open at all.

The GOP is traditionally ineffective in stopping looters once the virtue-signaling screams of “Don’t you even CARE???” get too loud.

The trial lawyers among are the rats biggest contributors. The Democrats will block any protections for businesses. This alone could kill a recovery.

Left wing turds are suing to release criminals from jail because keeping them there represents “willful negligence” ... of course releasing them to victimize the innocent is okay with Democrats.

How does anyone prove by a preponderance of evidence (>50%) required in a civil lawsuit that they contracted the virus in a specific place? They can’t.

I said when Obama was President and regulations were being passed that one day business would wake up and say they could not even do business.

It is the same now with liability. One cannot open or run a business for very long without the threat of lawsuit. One can have a business for years and then have a class action against them for any little thing.

3 years from now packing plants, or other factory businesses will be in court defending why they did not shut down tight in 2020 to keep someone from dying or being infected from ChicCom. Just wait.

If everyone does not act in lock step they are open to a lawsuit. Ridiculous.

The Democrats who control the House will fight against employer-protection legislation, because they WANT to destroy Trumps economy before the election, or at least hold it hostage for their desired $3 TRILLION goodies package.

Our local BSA council cancelled all in-person summer activities for the Scouts. They say with the shutdown conditions things are so uncertain that they can’t effectively plan the program. What they don’t say is that they can’t afford another lawsuit. If our troop leadership plans something independently the BSA insurance policy doesn’t cover us. Our chartering organization (a church) isn’t likely to cover us if the BSA won’t. That leaves it to the Scout leaders to personally carry the liability risk . . . not happening.

Or they might block it until after the election. If Trump loses then they might have to fight with the lawyers, but explain to them that by reopening the economy without lawsuits for coronavirus the economy may recover quickly. When the economy is a lot better then they can sue the pants off everyone rather profitably.

I’ve said from the very beginning that this was all about the trip and slip lawyers that you see on billboards and late-night TV ads. One unfortunate death of say, a college student, would cost them millions if they found the right jury.

There’s a bigger constitutional issue here. Almost all cases of civil liability are covered under state laws, so it’s likely impossible for Congress to pass any laws giving blanket immunity from civil lawsuits in COVID-19 cases.
