Flynn attorney files emergency appeal to shut down Judge Sullivan's orders, boot him from case

Michael Flynn's attorney Sidney Powell on Tuesday filed an emergency writ of mandamus to the D.C. Circuit Court of Appeals seeking the immediate removal of Judge Emmet Sulivan from the case -- and saying that under appellate precedent set by the "Fokker Services" case, Sullivan or his replacement must dismiss the prosecution, as the Justice Department has requested.

Writs of mandamus are extraordinary remedies, which are appropriate when there has been a "usurpation of judicial power" that is "clear and indisputable" -- and, Powell argued, Sullivan's behavior fits the bill. Powell also demanded the appellate court vacate Sullivan's order appointing an "amicus curiae" in the case to argue in favor of preserving Flynn's guilty plea on one count of making false statements to the FBI.

Great post.

When a judge assumes the power to prosecute, the number shrinks to two.

Judges gone wild. All too often.

She didn’t have a lot of success with Flynn in court.

When did she represent him in court?

“I get homesick every time I hear her lovely NC accent.”

When I moved to GA from TX the soft drawl and vowels were music to my ears. In TX we have a long drawl and hard vowels. I do still love to hear a Texan talk, but the deep south soft vowels are so lovely.

For example:

Adairsville

Texan pronunciation = A-dAirsville.

Deep South pronunciation = Hu-dursville.

Pure music to the ears.

I have a friend from Mississippi and I love her accent. She’s 70 and is proud of it.

“I have a friend from Mississippi and I love her accent. She’s 70 and is proud of it.

Oh, they do have the best drawl! Long and soft.

Quick story, there was a receptionist here in ATL that was in her 80’s. This was about 20 years ago. She and her sister were spinsters that still lived in the house they were born in.

I was doing some software training for the non-profit staff. Sitting by her during lunch, she turned to me and said (told in an accent similar to what you love about your MS friend), “I know how we can get rid of all these Yankees”.

I said, “Sue, tell me how?”

She replied, “Just turn the air conditioning off.”.

BTW, my friend was Miss Mississippi 1968. She’s still beautiful.

The women of the South are beautiful. From VA to TX. Personally, I think the folks in TX are the most fine looking.

Years ago we were in Washington, DC on the Metro, and my husband, who was not a looker on anyone’s chart, turned to me and said, “These are the ugliest people I have ever seen in my life.”

I said to him, “Dear, we are not in Texas any more.”

When did she represent him in court?

As I'm sure you know she made a number of filings and submissions to Sullivan's court.

Here's just one example of the outcome:

In a 92-page ruling, a federal judge dismissed Flynn's argument that he was targeted by politically motivated federal agents.

I trust you're not going to say it doesn't count because she wasn't physically in court.

Yeah, she ony got the prosecution to drop the case.

That's the point.

She didn't get it done in court, she got it done on Fox News.

I'm not saying she wasn't effective, only that it wasn't her legal skills that got it done.

LOL.

On the contrary, I think she’s very good on talk radio and Fox News, just not in court.

She was up against Judge Sullivan so what do you expect.

It’s BS that she’s not good in court.

You seem to dislike her.

Maybe getting removed from the case is what Sullivan wants. He’s smart enough to know this case stinks. He could have ended this months ago and didn’t.
