Generally, an appellate court only has jurisdiction when a case has gone to final judgment.

Mandamus is an interim appeal that is only for fairly extreme cases of a court exceeding its authority. It's difficult to get an appellate court to take one.

But, Sullivan's behavior is such that they just might take this one.

If they don’t take this mandamus, then it makes them look in on it. Since they JUST ruled on this recently, I think that that action compels them to not ignore it, but grant it.
