Arbery Family Lawyer: 'Justice by Video' Is Not Justice

The Atlanta lawyer who has joined the legal team representing the family of Ahmaud Arbery—who said he is working on litigation related to the fatal shooting, and predicts that “there’s going to be a ton of people getting sued”—certainly has experience in police shooting cases where video plays a crucial role.

In a phone interview with the Daily Report Thursday, L. Chris Stewart of Stewart Trial Attorneys would not give details of planned lawsuits, but he said he will serve as local counsel for S. Lee Merritt of Philadelphia, the civil rights attorney representing Arbery’s mother. Civil rights attorney Ben Crump of Tallahassee, Florida, is representing Arbery’s father.

Stewart said he has known both Merritt and Crump for years and was quick to say yes when Merritt asked for his help.

“This happened in my state,” said Stewart, who has traveled around the country to represent families of young, unarmed black men shot by white police officers.

Arbery was killed on Feb. 23. No arrests were made until May 7—two days after the release on social media of a video of the shooting. Gregory McMichael, 64, a former Brunswick police officer and district attorney investigator, and his son Travis McMichael, 34, were charged with murder and aggravated assault.

Crump has said the Arbery case bears a chilling similarity to the one that made him famous: He represented the family of Trayvon Martin—the teenager killed by a neighbor in Florida while walking home in 2012. The shooters in both the Martin and Arbery cases claimed justification because they were suspicious that the young men were involved in recent neighborhood burglaries.

Well, well. Crumb is finally right about someting. Arbery was a punk just like Trayvon. And just like Zimmerman was justified - so are the McMichaels.

So IOW we must be selective in deciding which videos to believe and which to reject.The video of the shooting doesn't show nearly enough to allow a reasonable person to form any opinions...in the dead guy's favor *or* the favor of the accused.

The story about him bringing a gun to a school is noteworthy.The video showing him trespassing as well as the two showing him acting like your basic hood rat are also noteworthy.

I,for one,am willing to consider any stories of the accused guys having legal trouble,drug of alcohol problems,etc,etc.

So far I haven't seen enough evidence to decide "guilty" or "innocent".

The parallel is in both cases men approached someone suspected of being up to no good and both were attacked by the suspect.

The lesson is, if you must pursue, keep your distance.

Martin might have been smart enough to not try to take a gun away from a guy he knew was armed.

... he just attacked a guy after he could have chosen to walk away and go home....

Since dead men tell no tales, without the video, what will the prosecution use for evidence to prosecute the defendants?

Fair Use laws permit us to post excerpts. I don't know about law.com as a site, but I'll bet they have no shortage of lawyers protecting their site's copyrights.

I the video I saw it like the guy got shot trying to take the cop’s gun, a big no-no.

Stop when told and live longer.

Neither of the assailants were current uniformed police officers with legal arrest powers.

Vigilante shooting yes

police shooting no

I guess they could sue McMichaels for the shooting, but I don’t see how the police department was responsible.

Martin’s girlfriend, a witness for the prosecutor, but turned out to be a better witness for the defense, stated that Martin made it home, and she coaxed him to turn around and look for that “creepy ass cracker” that was following him around the neighborhood.

Martin was looking for a fight, he just happened to bring his fists to a gun fight. That was his problem, not Zimmerman’s

He didn’t attack him knowing he had a gun was my point. St.Skittles only tried to take the gun when he realized the guy he was already beating in was armed.

Actually, Martin's girlfriend, Rachel Jeantel, wasn't really his girlfriend. She was an imposter hired by Crump (or so a lawsuit filed by Zimmerman claims).

The last video I saw was of Arbery (age 20 at the time), and about three other teens stopped by cops for allegedly shoplifting a TV.

Newly-released bodycam footage shows Ahmaud Arbery getting arrested in 2017 for trying to steal a 65inch TV from a Walmart - which led to five years of probation

Five years probation? So that means he was on probation when he was visiting the property in question multiple times over a period of months, and on probation when he grabbed McMichael's weapon, and fought with him. Gee, the poor guy never got to finish his probation. He was just one jog away from turning his life around.
