ALAMOSA – A 49-year-old Canon City man remains hospitalized after being shot during a downtown protest here early Thursday evening. At approximately 5:56 p.m., Alamosa Police were dispatched to Main Street and State Avenue in reference to a shooting.
After an initial investigation, officers quickly located the victim at 2nd Street and Richardson Avenue in a vehicle, with a gunshot wound to the head. Alamosa Police Department identified the victim of the shooting as 49-year-old Canon City resident, Danny Pruitt. Pruitt was initially treated at San Luis Valley Health and later flown to UC Health Memorial Hospital in Colorado Springs for further treatment. As of Friday afternoon, Pruitt was in critical but stable condition, according to APD Captain Joey Spangler. The Courier will keep the public updated on his well being.
Law enforcement identified a suspect, 27-year-old Alamosa resident James Marshall, and subsequently placed him into custody at approximately 8:40 p.m. Marshall was charged with attempted 2nd Degree homicide, 1st Degree assault, reckless endangerment, felony menacing, criminal mischief, illegal discharge of a firearm, and prohibited use of weapons. Marshall reportedly is an attorney with a second-story office in downtown Alamosa.

Police tell us a 27-year-old defense attorney shot at a driver during a protest Friday night on Main Street. Until then, the protests in town had been peaceful.
Police say the suspect, James Marshall, was on the streets when he shot a man who was driving. The gunshot victim was identified by police as 49-year-old Danny Pruitt of Canon City.
KRDO learned that Marshall is a defense attorney in Alamosa. State records show Marshall has practiced law in Colorado since at least October 2018. Those who live in town are stunned by the allegations against him.

Authorities arrested Alamosa defense attorney James Marshall, 27, for the shooting. Marshall is out on bond for charges of attempted murder and assault.
A GoFundMe set up by family members of the driver said Pruitt is a disabled veteran and single father. People have already donated over $100,000 to help with Pruitt’s medical bills. Pruitt is in stable condition with a traumatic brain injury. Family members say doctors are working to reduce brain swelling. The GoFundMe indicates additional tests will be done this week.
KRDO NewsChannel 13 obtained security camera footage, which has been provided to police, from a nearby business that captured the moments surrounding the shooting.
The surveillance video time-stamped at 5:55 p.m. Thursday shows the incident in its entirety during a protest in downtown Alamosa. The video shows about a dozen protestors were lining Main Street with signs in hand.
A black truck pulls up and as the driver goes through the crosswalk. That’s when a protestor reaches in their pocket and pulls out what police say is a gun. The surveillance video shows the protestor aim the object at the passenger side window of the truck.
Within 11 seconds of nearing the crosswalk, the truck comes to a halt in the middle of the intersection. Protestors immediately scatter and cars continue to drive around the stopped truck for about two and a half minutes. Video then shows the truck moving through the intersection.
KRDO has attempted to reach Marshall numerous times but has not yet received a response. It appears Marshall disconnected the voicemail at his law firm in Alamosa.
Attorney Randy Canney who is representing Marshall declined to comment on the case. The District Attorney’s Office in Alamosa also declined to comment but said the next court appearance is June 15 at 9 am.
