SCOTUS’s Transgender Ruling Firebombs The Constitution
The Federalist, ^ | JUNE 16, 2020 | Joy Pullmann

Posted on 06/18/2020 12:54:53 PM PDT by george76

The ruling will lead to a tsunami of polarizing court cases and further degradation of Americans' natural rights to free speech, to free association, and to worshipping God as their consciences require...

ruling inserting “gender identity” into the word “sex” in a 1964 employment law, the U.S. Supreme Court called a man a woman, possibly leading to eventually forcing everyone else to do so also. The ruling will lead to a tsunami of polarizing court cases and further degradation of Americans’ natural rights to free speech, to free association, and to worshipping God as their consciences require. All this in the name of “equality,” a word that has become a totalitarian weapon.

...

This decision is a disgrace to these bedrocks of Western civilization, our nation built upon them, the voters who vote for them, and to these men’s honor. President Trump ran promising judges who wouldn’t murder America, and Gorsuch just gave him and everyone who voted for him a giant middle finger. The court’s newfound weakness will also be exploited and explored by leftist legal agitators whose goal is the destruction of the American system.

“There is only one word for what the Court has done today: legislation,” writes Justice Samuel Alito in a dissent Justice Clarence Thomas joined. “…A more brazen abuse of our authority to interpret statutes is hard to recall.”

...

Fighting this may not work. That two-thirds of our nation’s highest court clearly despise the Constitution and the way of life it protects, and which it is their sole job to defend, may be yet another indication that the United States we know and love is heading into a dark night of oblivion, like all empires before it. If that is the case, however, I’m going down fighting as hard as I can.

There’s no reason to fight anything. I already started making my own contributions to this idiocy by identifying myself differently every time I complete an official document.

Imagine the surprise among my neighbors in this all-white town when the 2020 U.S. Census results come out and they learn that there’s a black women living here. LOL.

Honestly asking - Is it worth voting for any Republican? They might fuss and fume about this but are they going to introduce legislation that would counter it?

It is a fact of life that you have two choices, (R or (D). If you won’t support (R) then (D) will win.’
The smart thing is to Primary out the RINOS and Primary in the Maverick’s who will follow the Constitution. Don’t give in, TAKE BACK OUR PARTY.

Exactly. Fight or lose. Binary choice.

“are they going to introduce legislation that would counter it?”

It’s even worse than that. They can introduce all the legislation they want, but that can’t overrule a Supreme Court decision. It would take a Constitutional amendment to do that, which isn’t going to happen.

They’ll huff and puff about appointing better justices, just like Trump is huffing and puffing about packing the court, but the decision will stand, the justices won’t get impeached, and nobody is going to change anything. This is a done deal unless there’s a revolution or something.

“If you won’t support (R) then (D) will win.’”

Yeah, but you forgot to say “If you do support (R), then (D) still wins most of the time, because (R) won’t fight.”

Trump’s tweeting that he will have another ‘list’ that his next nominee will come from.

Just like Gorsuch.

No. I don’t want you making any such list or letting Ivanka and Jared make one for you. Your political appointments are awful.

The institution and much of the judiciary is a disgrace. This isn’t its first hallucinogenic decision. I view SCOTUS as a bunch of self-important jesters. They’ll get any result they want, has nothing to do with so-called “rule of law.”

You misunderstand. For sanctimonious conservatives, any little thing is grounds for not voting for a Republican.

Self righteousness is to many more important than America

Of course it is worth voting Republican! without Republican presidents, we would not have SCOTUS justices like Roberts and Gorsuch. Oh, wait...

If Roberts wants to be a legislator so bad, he should resign from the court and run for Congress. His court has been a disgrace. History will not look at him with favor.

Are you sure? The ruling interpreted legislation. Why can't they pass legislation that makes explicit whaty "sex" means? Of course, then that legislation gets "interpreted."

The smart thing is to Primary out the RINOS...

One would think so. That's pretty much what happened with Cruz - he overcame the establishment politician. Has he been vigorously responding to the insurrection? What is he going to do about this SCOTUS decision? The Dems win beause they scream night and day. When are Republicans going to start pressing their case loudly and without ceasing? Some people say that's just words. But, as Jeanne Kirkpatrick one said, that's what politics is.

Not in this case. The Court did not decide any constitutional question; they interpreted the Civil Rights Act of 1964, so Congress could fix it by simply amending that statute. Unlikely the current Congress will do so, however.
