Once congress has allocated the money to the Pentagon for national defense purposes, it would appear that the money has been placed under the direct control of the commander-in-chief. If the CIC chooses to use the funds to defend our southern border by constructing a border fence, then how does a court have more jurisdiction over the funds than the CIC. This decision by the 9th Circus of Appeals is nothing more than a stall and delay tactic. This decision will not prevail.

Otherwise any president can diddle the DOD budget in any way he wants, like use all funds to buy nerf guns and taffy. Has to spend the bucks in accordance with what it was appropriated for. . .unless he gets re-programming approval.
Article I, Section 9, para 7.
“No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law;”
This decision by the 9th Circus of Appeals should be ignored by the President, the court has absolutely no jurisdictional authority to make it. The military is under the control of the President only and he can deploy them to defend the Southern border if he wants to and instruct them to build the wall to defend the border.
