Homeowners association tells Florida man to take down Blue Lives Matter flag
WFLA8 Tampa ^ | 6=25/20

As a Pasco County Sheriff’s Deputy, Sean Kennedy spent 25-years following the law and enforcing it. Now he’s found himself in a position where he feels he must break the law. More specifically, a by-law for his community association.

Kennedy lives with his wife and children in the Foxwood subdivision in New Port Richey. It’s a deed-restricted community where lawns are neatly mowed and cars are parked in garages.

Over Kennedy’s garage flies a blue lives matter flag, the homeowners association recently told him he had to take it down.

The flag looks just like an American flag with the exception of black stripes and a blue stripe for law enforcement and a red stripe for firefighters.

“People don’t really understand that flag. It’s nothing to do with police,” said Kennedy. “It’s police that have been killed. The meaning of the flag is to support police that have been killed. Not police that are active right now working. “

Neighbor James Adams doesn’t understand why the association is all of a sudden asking Kennedy to remove the flag.

“I understand that there are certain guidelines and bylaws that we have to follow,” said Adams. “But that’s a little much.”

Kennedy believes he understands the timing. A member of the association told him someone complained. “I think it’s self-explanatory what’s going on in the world.,” said Kennedy. “The hatred of the police because of one horrible action by a guy in Minnesota just tarnishing everybody.”

Kennedy says a number of neighbors have weighed in and support his right to fly the flag. He says he has no intention of removing it.

“I’m not taking it down. It’s something I’ve worked for for 25 years and I believe in, so, and it’s definitely not racist, it’s definitely not hatred,” said Kennedy. “It’s a tribute to law enforcement officers and firefighters who died.”

8 On Your Side called and e-mailed the management association that sent the letter and are awaiting a response.

It’s odd that a “conservative” forum would be populated by so many that don’t give a crap about the biggest investment they’ll probably ever make in their life.

Our board is pretty loose and only raise he!! with a homeowner if they are doing or plan on doing something blatantly against the covenants they SIGNED and could potentially adversely effect property values.

Dues are 50 bucks a year and go into an account should an attorney be needed. Cheap dam^ insurance if you ask me.

A bit draconian, I think.

I was in an HOA, a basic one, it did good, and in my case, a next door neighbor bought into the development and then put a junk car and motorcycle in his front yard and left it there. Every buyer was provided a copy of the covenants (all 55 pages), so they knew what they were buying into and knew they were not supposed to do that.

That was not a good thing because I was trying to sell my home and the junk kept collecting (and the noise. . .they fought a lot) did not help.

When they were finally evicted by the Sheriff (backed by a court order) for HOA violations, the yard and home were cleaned up, my home sold straightaway.

How many times should we do this?

Guy moves into HOA with agreed to flag rules in place and signs off on them. Later decides he's special and flies the [insert flag nomenclature here] flag anyway - HOA says it's against the rules he, and everyone else, agreed to.

I forgot the part where half of FR - the moronic half which doesn't understand property rights - just blames the HOA anyway.

“How many times should we do this?”

1.2 thousands of times 15. It’s a contract to live in a place you call home, just like a mortgage is. Abide by the contract or leave. They don’t want you there anyway.

HOA's are ridiculous. The very concept is disgusting.

Really beautiful where I am, and safe for my family when I'm gone. Controlled access and security when the world is burning is a plus.

You can just stay the f**k out.. that'd be fine.

“What’s wrong with putting up a pole barn”

Our last house was in a rural subdivision with multi-acre lots, and houses had pole barns which were permitted under the very loose HOA rules. Pole barns were cool and almost everybody had one.

Our current house is in a crowded upscale subdivision with more stringent HOA rules. If someone wanted to put up a pole barn here, I’d be the first one screaming. (It never would happen, anyhow.) Each home would drop $100K in value.

Personally, I’m a farm girl and despise HOAs. Hubby is a city boy and loves the Stepford look. [sigh]

Why would ANYONE buy a home with an HOA?

If that's a serious question, the reason why some of us like HOAs is because some of those neighborhoods are very beautiful, secure and very nice places to live and raise a family.

Also, with your dues, depending on the community, you can get a LOT of value for your money, like irrigation, high speed internet, landscaping, security, sports. It's a small price to pay for not flying jihad and rainbow flags.... oh and the blue line flag too.

Does that answer your question?

You buy into an HOA and you get what you pay for and you are welcome to every bit of it

As someone who has dealt with HOA boards professionally, I can tell you that this HOA is on solid ground. In fact, they'd be derelict in their responsibilities if they allowed him to fly any flag that didn't conform with the HOA bylaws and other governing documents.

As one notable condominium lawyer once told me ...

"If you allow one homeowner to fly an Ohio State University flag in violation of your bylaws today, you undermine your authority to stop another homeowner from flying a Nazi flag tomorrow."
