A federal appeals court has vacated the death sentence of Boston Marathon bomber Dzhokhar Tsarnaev, based on the opinion that the judge in the case did not vet the jury properly with regard to possible bias stemming from pretrial publicity.
A core promise of our criminal-justice system is that even the very worst among us deserves to be fairly tried and lawfully punished a point forcefully made by the then-U.S. Attorney for Massachusetts during a presser at the trial's end," the three-judge panel wrote.
They added: "To help make that promise a reality, decisions long on our books say that a judge handling a case involving prejudicial pretrial publicity must elicit 'the kind and degree' of each prospective juror's 'exposure to the case or the parties,' if asked by counsel, see Patriarca v. United States, 402 F.2d 314, 318 (1st Cir. 1968) only then can the judge reliably assess whether a potential juror can ignore that publicity, as the law requires. But despite a diligent effort, the judge here did not meet the standard set by Patriarca and its successors.
Tsarnaev was convicted and sentenced to death in 2015 for carrying out the April 15, 2013 attack at the marathon finish line with his older brother Tamerlan Tsarnaev, who died in a shootout with police after a manhunt.

Reads to me like they searched for some reason to overturn the death sentence. Did not the prosecution and the defense participate in selecting the jury? And if it was such an issue, why didn’t the defense move for a change of venue? How long before some Massachusetts governor commutes his sentence and even allows weekend furloughs?!
Is there a general population in Super Max? I thought they’re all isolated from each other - in their cell 23.5 hrs a day.
Did anyone really believe he would get the death penalty in Massachusetts!!!
Hopefully they’ll know who he is; unless he’s moved to some other prison. Is Super Max federal or state?
I still want to know about this guy who was obviously considered suspicious by a bomb sniffing dog and subsequently handcuffed by the Boston Police.

I was incensed when I saw the headline, but when I read the stiry I realized that it wasn’t that bad. What the panel ruled was that, because of the bias expressed by some of the jurors, the death-penalty phase of the trial had to be done again with a new jury, and probably not one drawn from Boston. So he’ll get the death penalty again.
Ummm, he did, actually. On February 20, 1996, the Court GRANTED a change of venue and ordered that the case be transferred from Oklahoma City to the District Court in Denver, to be presided over by District Judge Richard Paul Matsch.
Furthermore, after his conviction, McVeigh DROPPED his remaining appeals after the first one was denied, saying that he would rather die than spend the rest of his life in prison
If that’s the outcome no harm will be done.
But I don’t like the sentiment at all. Nor the waste of having a do over.
