DOJ: Firm Discriminated Against Americans in Favor of Foreign Workers

An IT staffing services firm, with an office in Hyderabad, India, discriminated against qualified Americans for white-collar jobs in favor of foreign workers with the Optional Training Program (OPT), the Department of Justice (DOJ) concludes.

This week, DOJ attorneys announced a settlement with AllianceIT — which has billion-dollar corporate clients such as Cisco, CVS, Expedia, Humana, IBM, JPMorgan Chase, and Wells Fargo — after the firm was found to have discriminated against Americans for jobs in favor of foreign OPT workers.

AllianceIT, according to the DOJ, discriminated against Americans with job postings where they advertised for “ONLY OPT’s who can work.”

As Breitbart News has long reported, the OPT program ensures that corporations like Amazon, Google, Deloitte, and Intel can hire thousands of foreign nationals at a 15 percent discount. Foreign OPT workers originally arrive on F-1 student visas before they can eventually enter into the program to remain in the U.S. and take white-collar jobs.

The program helps shift billions of dollars from heartland communities to metropolises in blue states with wealthy residents.

Assistant Attorney General Eric Dreiband of the Civil Rights Division said in a statement:

'Companies cannot place U.S. students at a disadvantage for job opportunities by advertising a hiring preference for foreign students with visas. The Department of Justice will vigorously enforce the law to ensure that employers are held accountable whenever they discriminate against U.S. students or other U.S. workers because of their citizenship.'

The DOJ settlement contains no financial penalty for AllianceIT, only requiring the firm to comply with the Immigration and Nationality Act’s anti-discrimination provisions in their policies and hiring practices. DOJ attorneys said the firm will be subject to federal monitoring for two years. [...]

Just once I would like to hear about a company that actively discriminated against foreigners in favor of locals.

Of course the government would go after any that did.

In other words, "We caught you redhanded breaking the law; your penalty is that you will be required to not break the law." I want that deal the next time I rob a bank.

The Indian-dominated tech industry is very powerful and has the State Department, the USCIS, the DOJ, the majority of the Senate (except for Durbin and Scott) and the House in its pocket...

Scary stuff that we sold out to India.

“AllianceIT denies that the discriminatory advertisement was placed with the intent of committing intentional citizenship status discrimination”

Again, I want this deal the next time I rob a bank: “NobleFree denies that he pointed a gun at the teller and demanded all the money with the intent of committing intentional bank robbery.”

Was it intentional? I don’t know. Could just be that they handed off their recruiting to idiots in Hyderabad who did not know jack about our employment laws.

But in every other instance I know of, ignorance of the law is no excuse.

I mean, on the one hand you don’t have to pay them very much; but on the other hand, they just watch webcams all day asking to see bobs, so it’s a trade-off.

The whole thing is insane. No healthy culture would do this to itself.

Why is it that the clients of this company - CISCO, CVS, Expedia e.t.c, did not get into trouble for this scheme?

It is a nice scheme, hiding behind some company based out of India. They can pretend to know nothing, looking clean and straight.

I had a chance to do a series of interviews with Pyramid Consulting, an Indian-owned firm with a large American presence.

I went through 3 interviews, aced them all. Was not hired, in favor of an Indian H1B guy.

They stick to their own.

When we get upset we tend to get in our boss’ face.
They are used to a more compliant workforce, one that
seeks to avoid conflict.
