The original SCOTUS was a six member court.
We’ve had as many as ten.

With Ginsburg’s seat vacant, that leaves:
- 4 “known conservative” votes
- 1 “swing vote” (Roberts)
- 3 leftist votes.
Roberts is likely to lean towards the Constitutional position, along with the other conservatives.
Now an 8-member Supreme Court has actually become MORE conservative than it was yesterday.
Ha ha ha!!! Are you kidding?! Roberts is likely to lean as far over his feet as he possibly can, so as to get a firmer grip on his ankles.

You are correct, that’s the way it looks on paper. The question is how will Roberts act? If it ends up 4-4, the decision of the lower court prevails. In the case of the Michigan Supreme Court that will likely show up very soon, that would be a disaster for the Republic.
He has a chance to save the Republic and help the nation through this election. I hope that he does the right thing.
