We’ve had as many as ten.

With Ginsburg’s seat vacant, that leaves:
- 4 “known conservative” votes
- 1 “swing vote” (Roberts)
- 3 leftist votes.

Roberts is likely to lean towards the Constitutional position, along with the other conservatives.

Now an 8-member Supreme Court has actually become MORE conservative than it was yesterday.

Nope,no way! Roberts will side with the Maoists.So that means a 4-4 vote which would leave in place whatever decision the lower court announced.So it will be *that* court which decides the particular issue at hand.

You are correct, that’s the way it looks on paper. The question is how will Roberts act? If it ends up 4-4, the decision of the lower court prevails. In the case of the Michigan Supreme Court that will likely show up very soon, that would be a disaster for the Republic.

He has a chance to save the Republic and help the nation through this election. I hope that he does the right thing.
