Trump to Make Supreme Court Nomination Friday or Saturday. President has five women under consideration to replace Justice Ruth Bader Ginsburg

President Trump said he would nominate a Supreme Court pick on Friday or Saturday and has five women under consideration to replace Justice Ruth Bader Ginsburg, as Senate Republicans lined up behind him and Majority Leader Mitch McConnell (R., Ky.), rejecting Democrats’ calls to let the winner of the presidential election make the pick.

Mr. Trump maintained that the replacement of Justice Ginsburg, who died Friday of metastatic pancreatic cancer at the age of 87, should happen swiftly. “We won the election and elections have consequences,” he said Monday morning on Fox News. “We have plenty of time.”

The president’s list has been narrowed to two leading candidates, according to people familiar with the matter: federal appellate judges Amy Coney Barrett of the Seventh Circuit, in Chicago, and Barbara Lagoa of the 11th Circuit, in Atlanta.

The president said he has three other people to choose from, though declined to name them. He said he was looking for someone who is young and could serve on the court for a long time. “We’re looking for a good person.”

Judge Barrett, 48 years old, was confirmed to the U.S. Circuit Court of Appeals in October 2017 in a 55-43 vote. She is popular among social conservatives and was a finalist for the post in 2018 when Mr. Trump chose Justice Brett Kavanaugh. Judge Lagoa, 52, previously served as the first Hispanic woman on Florida’s high court.

More than 20 Senate Republicans said over the weekend that they back moving immediately to fill the vacancy, and many are expected to follow suit as the week gets under way. Two Republican senators—Sens. Susan Collins of Maine and Lisa Murkowski of Alaska—broke ranks this weekend, saying they oppose action on a nomination before the presidential election.

Hopefully it won’t be Lagoa.

If Collins and Murkowski are against it, if the nomination comes to the floor for a vote, are they saying they will vote no to the candidate? Need a bit more clarity to their responses.

He should nominate all five of them, and pack the Court with them if he wins.

Yes but she had surgery about a year ago and has been in and out of hospital so many times over the past 2 years. Everyone knew she was going to pass soon like all of us will eventually.

Hat Tip to SeekAndFind, who made this excellent post on another thread. The article also has a direct link to the dissent itself. It's worth the read if you have the time and inclination. Dissents are where the rubber meets the road in judicial opinions. Opinions themselves tend to be consensus documents, not as good a guide as the dissents are.

Judge Barrett actually dissented in a Second Amendment case and WROTE her reasons why.

He needs to wait until at least her memorial service is over.”

Under normal circumstances yes, but these are not.

...Land pack the Court with them if he wins.

How? Congress (House) needs to vote to approve the changes on the number of justices.

On November 28, 1975, President Gerald Ford made his only Supreme Court nomination when he selected federal judge John Paul Stevens to the nation’s highest court.

When the Senate considered John Paul Stevens’s 1975 nomination to the U.S. Supreme Court, he didn’t get a single question about the Roe v. Wade abortion-rights decision issued less than three years earlier.

And even though Stevens was replacing a polarizing justice appointed by a president from the opposite party, his nomination sailed through the Senate, which confirmed him 98-0 only 19 days after his selection by Republican President Gerald Ford.

We have to get a new Justice by or right after November 3.

38 days is twice as long as 19.

Trump should have been prepared to replace e RBG long ago.

He's very prepared. He already had a list four years ago and he recently updated that list. President Trump had already decided that he was going to replace RBG with a woman and there are 11 women on his list. Over the weekend, he has already chosen five finalists from his list and it makes sense for him to take five days to thoroughly interview each one of them.

“Not good, every minute that passes makes the pre election vote less likely. he should have announced it this afternoon.”

Trump has been pretty good at timing things. He probably has more information available to him than we do.

For one thing, he is pausing a respectable length of time after RBG’s passing. His deference to her may mean something to the ever-important soccer moms.

And during this pause, I'm sure he is smoking out both dims and rinos. By Friday Pelosi will be in curing concrete up to her ice cream cone.

Once the opponents are fixed into position, they can be maneuvered around.

Oh, I agree - what I’m noting is that the very likely outcome has been known since at least 2009, so it hasn’t been a surprise for a long time.

She should have retired during the Obama admin if she wanted to be sure of a replacement who shared her views, given the outlook on her future health (even if you forget her age).

It would be bad optics for Trump to nominate somebody even before RBG has had her funeral.

Do we even know the Dems are not going to turn that funeral into another George Floyd type funeral, dragged over several weeks and milked by the Dems for every political advantage they can get? The Dems have a very long history of doing that, from the Wellstone funeral to the Ted Kennedy funeral.

Under normal circumstances yes, but these are not.

If memory serves, I believe in Judaism the person is supposed to be buried within 3 days.
I expect the Dems are going to want to drag it out as long as possible to slow things down as much as possible. Expect a demand for a long memorial/mourning period.

By waiting until the weekend President Trump will assure coverage of his announcement on all weekend shows.

By waiting, he will give the Senate Republicans time to formulate and solidify their blitzkrieg to confirmation.

By waiting until the weekend, he will give all Dims, Marxists, Communists, Fascists, Antifa, BLM, Planned Parenthood, Atheists, Wickens and assorted Leftists an opportunity to, as my southern mother would say, “show their asses.” The week will be a constant drumbeat of protests, riots, gatherings at individual homes, and calls to violence from elected Dim officials.

Good point but they are dealing with Trump this time. He’s given them a week and already stated he will have the nominee announced this Friday or Saturday. I doubt he backs away from that timeline if the Dems decide to slow-walk the funeral.

It’s a good thing we know the Dems are going to use the delay to plan how to help Trump get the nomination through.
