Pros And Cons For Three Top Contenders To Replace Ginsburg On Court
The Federalist ^ | 9/24/2020 | Mollie Hemingway

The confirmation battle to fill Justice Ginsburg's seat could be apocalyptic. Here's the strategy behind some of the president's top contenders.

President Donald Trump will make his third nomination to the Supreme Court on Saturday. The initial plan was to make the nomination very quickly following the death of Associate Justice Ruth Bader Ginsburg last Friday, but it has been delayed so that the country may properly mourn the justice known for her support of liberal social causes. Ginsburg was appointed by President Bill Clinton 27 years ago. A reliable vote for the left block of the court, she was also beloved by her fellow justices for her friendship and sparkling wit.

Filling the vacancy is a priority for conservatives, many of whom have been frustrated by Republican presidents repeatedly squandering judicial nominations on justices who disappoint. One in four Trump voters said that they voted for him in 2016 because of how important the Supreme Court was. President Trump had put out a list of potential nominees and promised to pick from that list. He did so when he nominated associate justice Neil Gorsuch to the bench. Later he updated the list with associate justice Brett Kavanaugh and other candidates. Just weeks ago he updated it again. He has said the next nominee will be a woman.

While Democrats and NeverTrump adherents have begged Republicans not to fill the seat, some threatening to pack the court or otherwise retaliate if the Constitutional process proceeds, Republican voters and those they elected have declined to pursue failure as their first strategy.

Most observers believe that the top two contenders are Judge Amy Coney Barrett and Judge Barbara Lagoa. Here’s a quick look at both, along with a non-female on the list who might be worth considering.

Like Hemingway, but she lost me at Mike Lee.

Is there a candidate with more experience and more certainty?

I must have missed their staunch defense of the Second Amendment. Most important issue of this nomination, skipped completely.

I can’t seem to shake the thought that Sandra Day O’Connor was considered conservative when she was appointed to the court, then she “evolved”.

I don’t know about apocalyptic but the left is already apoplectic.

LOVE Hemingway but as with you don’t know why he’s mentioned here. The notion that, if the first nominee were to fail that he could be confirmed seems very unlikely

Trump staying overnight at his Doral resort in Miami - can’t imagine him not meeting with Lagoa sometime tomorrow.

There must be SOME way to get a clue as to whether a justice will “evolve” on the court. It has happened so many times now, you would think someone could try to develop a methodology to predict whether they will be like Scalia/Alito/Thomas or O’Connor/Kennedy/Roberts. Maybe a behavioral scientist could develop psychological profiles of the reliable versus unreliable conservatives. I don’t know if it could be done, but someone should at least look into it. They’ve got to stop winging it and hoping for the best.

“Is there a candidate with more experience and more certainty?”

You would think that if Republicans learned anything from the Souter fiasco, that an extensive record is crucial. No stealth candidates. No surprises.

Of the two women discussed, Mrs Barrett appears to have More of a track record and the second lady looks quite promising ( except for her political ties) for the future. I don’t comment on Senator Lee since he’s ineligible for this nomination per PDJT ( at least until he starts swearing a dress).

A quick look at a non female on the list?

A non-female? What sort of wording is this?

Does she mean a man, a male? Or is she one of these people who believe in 50+ genders?

He’s a male but he’s not a man. He can’t keep himself from being a RINO even though he knows it’s deadly in this political environment..

Lee would be a disaster.

Ann Coulter was infatuated with Mitt Romney. Laura Ingraham was infatuated with Chris Christie. It appears that Molly Hemingway is infatuated with Mike Lee.

No to Senator Mike Lee.

A better replacement for Breyer would probably be Amul Thapar.

Mike Lee is a disaster as Senator, him on the Supreme Court would be a nightmare.
