LANSING, MI -- Michigan Attorney General Dana Nessel will no longer enforce the governor’s executive orders by criminal prosecution, though she urges residents to continue following COVID-19 safety guidelines.
The announcement from Nessel’s office comes after the Michigan Supreme Court decision on Friday, Oct. 2, ruled the governor does not have authority to extend emergency orders under two emergency acts -- the Emergency Management Act from 1976 and the Emergency Powers of the Governor Act from 1945.
Neither act, the court ruled, gave Gov. Gretchen Whitmer the authority to continue declaring states of emergency or issuing unilateral orders under them past April 30, when her initial declaration would have expired.
The attorney general’s statement was released Sunday, Oct. 4, by press secretary Ryan Jarvi. The decision by Nessel’s office, Jarvi wrote, “is not binding on other law enforcement agencies or state departments with independent enforcement authority.”
The statement notes it is the attorney general’s “fervent hope” that people would continue to abide by measures put in place by the governor, including the use of face masks, social distancing guidelines and staying home when sick.
“If it weren’t for the governor’s actions, countless more of our friends, family and neighbors would have been lost to COVID-19,” the statement said. “We can respect both the court’s decision and the advice of medical experts by continuing with these important measures voluntarily.”
Whitmer previously said the emergency orders would remain in place for 21 days from the court’s decision, and that many of her responsive measures would continue under alternative sources of authority.
Several Michigan law enforcement officials, including Leelanau County Sheriff Mike Borkovich, Benzie County Sheriff Ted Schendel, Manistee County Sheriff Ken Falk and Mason County Sheriff Kim Cole said months before the court’s decision that they would not strictly enforce Whitmer’s orders...

NOTE: This “authority only extends to LAWS passed by the legislature and signed by the governor. It must be a duly established LAW for them to enforce it.

A friend of mine is Mayor of a small city in northern PA. His police do not enforce any of Wolf’s illegal edicts.
They had a car show a while back. They got almost twice the exhibitor cars than they normally have.
They do.
My county had stricter rules than most of my state for a large period of time since March. Everyone had to comply. I do not live in Michigan.
However, Trump has done nothing to stop these Nazis.

It appears the Dems in Michigan weren’t as skilled at packing their Supreme Court with yes-men as the Dems here in PA were.
Now that it has been settled that the Governor acted without legal authority, the claims for damages need to roll in, Immediately.

Trump swore an oath to protect and defend our nation from all enemies foreign and domestic.
He needs to lead instead of taking a backseat. The Left took over the narrative.
He can use the power of the federal government. The federal government make states do lots of things. For the riots he can use the army or various federal law enforcement agencies to stop them. It is an insurrection. He can use the bully pulpit. I am sure there are federal assets the can use.
