I disagree with the Markey, but if he were right (which he is not), there is a solution in the Constitution, it’s called the Constitutional amendment process.
But the Left, the Progressives and the Libs hate that process because changing the Constitution by the amendment process requires (a) a super majority in Congress and (b) a super majority of state legislatures to agree. That means it requires a really broad consensus of the people.
The Left, the Progressives and the Libs prefer to simply get an activist majority in the Supreme Court to invent, by judicial fiat, what is not found in the Constitution, whenever it pleases an agenda they cannot get by going to the people and obtaining a broad consensus. They prefer the judges to impose their own “living Constitution” on the people instead.
The whole Left, Progressive, Lib “living Constitution” via activist judges is a denial of the first words of the Constitution, which names it’s authors, and it’s not the judges, it’s We The People. And that will is carried out through the people’s elected representatives in the U.S. Congress and the states’ legislatures, not judges.
The “living Constitution” activist judges have wrongly grabbed a power that the Constitution gave to the people, acting through their elected representatives. It would take a truly Conservative legislature but if we had one I would use it to impeach all judges, in all courts, that accept the theory of a “living Constitution”; and I’d ask for re-hearings on cases wrongly decided in support of that theory.
Any other method of interpretation alters the COTUS which is the exclusive power of the People not the courts.
