Harvard Law School Professor Emeritus Alan Dershowitz, host of The Dershow, told Breitbart News on Thursday that President Donald Trump is likely to win a lawsuit his campaign filed in Pennsylvania challenging the legitimacy of mail-in ballots received after Election Day.
Dershowitz predicted that the U.S. Supreme Court would take up the Trump campaigns lawsuit if the number of votes being challenged are enough to change the outcome of the presidential election in Pennsylvania.
I do think that Trump will win the Pennsylvania lawsuit, said Dershowitz on SiriusXMs Breitbart News Tonight with host Joel Pollak, namely, the lawsuit that challenges ballots that were filed before the end of Election Day but not received until after Election Day.
Dershowitz continued, The [Pennsylvania] legislature had basically said no to that and the [Pennsylvania] Supreme Court said yes because of the pandemic. That may have been the right decision in some theoretical sense, but the Constitution doesnt permit anybody in the state but the legislature to make decisions about elections.
That was decided correctly in Bush versus Gore, and I think that four-to-four vote would become a five-to-four vote if the issue came before the Supreme Court and there were not disputed ballots to make a difference in the outcome of the election. That remains to be seen.
Dershowitz remarked, As I understand the facts of the case although I think what the judiciary did may have been the right thing morally: if you get your ballot in on time, you shouldnt be denied the vote just because the post office screwed up I dont think you can really make that argument under Article Two. I do think that the Republican argument is the stronger one.

I hope there are enough votes! This was always one of the best shots at getting a state back.
Exactly the opposite. The more votes at stake, the less likely Trump is to prevail.
And it’s not votes; it’s ballots.
We still need MI + GA or AZ even with PA.
All the President needs to do at this point is to show foreign interference in the elections.
At that point most state legislatures will consent to vote their own slate of electors.
He doesnt even have to prove WHO. There are plenty of statistical anomalies. If they can be proven to have originated offshore-BINGO -the state legislature will NOT certify the vote

While Dershowitz is no conservative, he is an excellent lawyer.
Trump will have to prove that there are enough irregularities on several states that could swing the election before the SC will rule that the vote is irredeemably compromised and overturning the results.
Does anyone know if Trump’s challenge still has a chan ce? I thought it was over.

Is PA enough? Doesn't the President need one more state to insure his victory?
My understanding ending was that it’s over. I think the Biden’s had China put the fix in and it worked. But I thought even Trump is not telling people he’s going top prevail.
