Second post from you that is quite defeatist and completely untrue. You know it is untrue. The filing from Giuliani is available online— how about you read it. And then, not derive some conclusion by extrapolation from what you “think” Trump expects. You are in for a shock, or maybe not since this seems to be agitprop. Na Zdorovie, have another snort for “balance”.
There's way more than that.
I am the antidote to hopium.
I am a lawyer with decades of experience, much of it in Fed Court. I think the 3rd Circuit ruled correctly, based on the narrow question put in front of it.
It is an axiom that Federal courts MUST rule on the actual, narrow, case and controversy in front of them. They cannot go outside of what is put before them. Otherwise, they would not be adjudicating a dispute, they would be making law, which the Constitution reserves to Congress, not judiciary.
The fact that the Republican-appointed judges adhered to this important principle is an indication that they are honorable jurists.
The blame lies with Giuliani, not with the judges.
I wrote on it extensively here. Scroll down to 203. You can scroll down further to see my recommendation on “what’s next?”

This Spectator article, soberly written and non-conspiratorial, from a publication that is regarded as a thoughtful and intelligent conservative voice, has convinced me that there are serious questions regarding the election.
I never denied there was fraud. I just believed that it wasn't a game changer and that Trump had mostly himself to blame for failing to overcome this handicap.
I no longer believe this.
While I continue to believe Trump will not win in the courts, I am a pessimist here, and that Joe Biden will be inaugurated next January, there is no denying the obvious fraud that took place, fraud that I no longer doubt was enough to change the outcome of the race.
I believe that President Trump legitimately won Pennsylvania and accepting this, he likely won other battleground states as well.
He will not win in the courts but he did not lose this election.
No matter what happens in January, President Trump should never concede.
