If you're wondering whether your employer can require you to get a COVID-19 vaccine to return to work, the short answer is yes. But that doesn't mean employers won't face a "legal minefield" if and when they decide to implement a vaccination policy.
Although employees can be required to take a test as a precondition of their returning to work, according to trial attorney Misty Marris, "there is no world where there is a COVID-19 mandatory vaccination policy that doesn't have exceptions to it."
Marris, who deals heavily in employment law, is the co-managing partner of the New York office of Gordon Rees Scully Mansukhani LLP.
As the U.S. waits for the COVID-19 vaccines from Pfizer/BioNTech, as well as Moderna, to get emergency use authorization from the Food and Drug Administration, employers have to be ready to set up a framework for how employees will be allowed to come back safely.

Yes
My wife works at a nursing home and has to take a covid test twice a week. She also has to do a TB test every year but it irritates her skin making it look positive and so she has to go get a chest x-ray at our cost. I’m quite sure they’ll make her get the vaccine.
Yes it can. You don’t the full protection of the Constitution when you’re entering a voluntary relationship with an employer for a job. He can demand that whatever conditions he wants in exchange for employment.
Yeah. You’ll have to go over to the Mexican side of town and buy an immunization card. They are probably already printing them up.
Yep. Unless you’re in Montana, you’re in an “at-will” state and can be terminated for anything (that’s legal, anyway). This might help: https://www.ncsl.org/research/labor-and-employment/at-will-employment-overview.aspx
LOL!
Is there a limit to how many times you can receive the vaccine?
A true leader would take the vaccine many times in amongst the people to prove the safety.
not if they are deemed illegal requirements they sure the hell cannot
Probably not, but can probably fire you if you don’t.
How many Americans die each year of small pox these days? Polio?
This legal dilemma is precisely why I suspect many employers will have most of their staff work from home permanently. What happens when an employee who is forced to take a COVID-19 vaccine suffers adverse side effects from the vaccine? These labor law firms are going to have a ton of business coming their way no matter what happens.
Good luck getting a vaccine deemed illegal under Biden.
My company brings in a flu shot company every year I guess. I never went over to check it out. In two weeks it’ll be another year without any sick days.
I tend to get bronchitis every year or so but that’s about it.
My company always pushes the flu shot. This year it’s come across as a very hard & insistent sell. I won’t buy. I haven’t done so since about 2009 when I was very ill with that flu shot. Won’t do it again.
The polio argument doesn’t stand as this is in essence a mandate
didn’t think he ran scrotus
or anything else at the moment
Will never ever sign a consent form.
Look up the National Childhood Vaccination Act of 1986. There may be some compensation but protects manufacturers from lawsuits
“Is there a limit to how many times you can receive the vaccine?”
Only need to take it until you are infertile. That’s the UN/WHO/NWO’s world population reduction plan, anyway. Trojan horse vaccines are their current method of choice. A 90% reduction is their eventual goal. Ask Bill Gates.
