Conservative Media Respond to Smartmatic Legal Notices: From Meekness to Defiance

Election software company Smartmatic is threatening to sue a number of networks for defamation, just days after serving a legal notice to attorney Sidney Powell.

Smartmatic sent legal notices to media companies Newsmax, OANN, and Fox.

In a press release, the company’s CEO says the networks “have no evidence” of their claims that Smartmatic is potentially involved in election fraud. He says “This campaign was designed to defame Smartmatic and undermine legitimately conducted elections.”

The company is demanding retractions.

Newsmax issued a statement about their coverage on Smartmatic and Dominion Voting Systems: “Newsmax would like to clarify its news coverage and note that it has not reported as true certain claims made about these companies.”

A few shows on Fox News that reported on the potential fraud issues also broadcast a segment, with an expert claiming some fraud allegations against Smartmatic are false.

Attorney Sidney Powell also received a legal notice from the company. Lin Wood, now representing Powell in the defamation claims, told Smartmatic’s lawyer to “file your lawsuit.”

Americans enjoy protection from the First Amendment. Truth is a defense in defamation cases.

If the voting companies were to file lawsuits, they would need to prove the networks’ coverage is false. And if the voting companies are considered public figures, they also bear the burden of proving the networks acted with malicious intent.

But some have pointed out the legal notices alone might have done the work, given the high cost of lawyer fees and the fact that litigation could scare investors.

I heard bannon did today but dont know if true

Rudy threw her under the bus.

I think Trump likes her and byrne because they “sing his tune”...but Ivanka and Kushner have put the kabosh on it.

Mark Meadows side won.

Lawsuit already filed by Coomer against powell, rudy, trump campaign.

Another one is imminent...supposedly

the lawsuits may be why powell is being thrown under the bus and they are disassociating with her.

Truth is a defense in a defamation lawsuit.

I, for one, want to see those lawsuits filed, and I want full-blown fact discovery, with subpoena issued against all third party witnesses.

It will take a year or two for the case to go to trial, but the nation will be better off if all the facts see the light of day.

Here is the problem

Some guy claimed that Coomer said he would make sure Trump wasn’t elected. Powell ran with it.

Coomer said it is a lie. There was never a call. He never said it.

This will be front and center to the lawsuit

Powell better be able to prove it.

I have tried to substitute Newsmax for Fox News, but I find I am not liking Newsmax at all. This is just another reason to drop Newsmax and their obnoxious emails, including one which was a barefaced attempt to proselytize Jews. I had to just stare at that one, incredulous that they would dare to send that to my email.

So far the courts haven't allowed any actual evidence to be allowed in court, even from The President of the United States.

Do you have any information that that might change?

If not, she's going to have a hard time of it.

Imagine being able to demonstrate in a court of law that everything you have written or said about the Dominion machine was TRUE.
That they are easily manipulated, even remotely via internet.
That you can create votes out of thin air or switch votes from one candidate to another on the fly.
That you can give votes greater or lesser value, fractionally, to influence total counts.
That you can adjust software to permit or exclude signatures on mail-in ballots.
That you can add votes simply by plugging into the open port conveniently left available on the machine.
But that won’t happen in today’s courtrooms. Only honest ones.

If I make statements based on what someone said about you, I had better be able to PROVE those statements were made, and that I had legitimate reason to believe them, or my ass is toast and you win.
