Donald Trump wants Rudy Giuliani and Alan Dershowitz to defend him against impeachment - as the celebrity attorney says it would be an 'honor and privilege' to represent him again

Donald Trump has started putting together a defense team for a second impeachment trial with Rudy Giuliani and Alan Dershowitz said to both be in the running.

Two sources told CNN Giuliani, Trump's personal attorney and the man who spearheaded the president's failed legal efforts to overturn the presidential election, is expected to represent Trump if the unprecedented event of a second impeachment trial materializes.

The sources said Trump is also considering hiring Dershowitz, the controversial celebrity attorney who represented him at his first impeachment trial in December 2019 for abuse of power and obstruction of Congress.

Quite honestly, I think a team of lower-profile, highly qualified attorneys would be a better choice. But there will never be an impeachment trial - McConnell will never permit it before Jan 20, and after then it’s moot.

Dershowitz says its not possible to convict him as he will be a private citizen then and the Constitution only addresses he Presidency.

They’ll never be a trial. The only person is just to further throw mud at his legacy by making him the only president to have two impeachment attempts. They’re just trying to smear the man and his legacy. Sad.

The Constitution is silent as to a time limit for an impeachment. So some legal scholars think an impeachment is possible even after the person has left office.

But why bother? Because after impeachment in the House comes a trial in the Senate. And if the Senate convicts, it can then hold a vote to bar the convicted person from federal office for life.

That might be the goal all along.

John Roberts would preside at an impeachment trial. And I have to think that even he would rule that such a trial would be moot. Impeachment exists for the sole purpose of removing an office-holder from his position. As of Jan 20, Trump will no longer hold that position.

And if the Senate convicts

If we get there, it would require a 2/3 Senate vote. I can't believe Republicans would dare - they already know their voters are furious, they already know Trump's approval ratings rose after Wednesday.

If the democrats go through with this Impeachment threat, they will regret it the whole time they are in office. If Biden had any brains, he would tell Pelosi to back off.

These are democrats he's dealing with. Facts don't matter. (see election fraud, Ukraine, Russia-Russia-Russia, etc.)

President Trump's team could present an ironclad case on his behalf, and the democrat-controlled House would impeach anyway. They know the Senate won't do anything before noon on January 20th, but if Pelosi, Schiff, et al., had any common sense, they wouldn't be democrats.

The goal is not to remove him by impeachment, its to rub his face in the loss and the House can just order a floor vote next week, that is the impeachment.

The conviction of the indictment can come later next month, that would stop him from ever holding office again and deprive him secret service protection and other benefits he’d lose as a private citizen under impeachment and conviction by the Senate.

I thought that too until recently. But then I did a little digging. The impeachment process actually has two purposes. One, to remove a person from a federal office (as you noted). And two, to bar that person from ever holding any federal office ever again.

That little-known barring thing has actually happened to a few impeached federal judges.

I agree. In addition, Roberts is too concerned about his legacy to let this kangaroo trial go forward. It would be cool if he said they didn’t have standing.
