Supreme Court ends Trump emoluments lawsuits

The Supreme Court on Monday brought an end to lawsuits over whether Donald Trump illegally profited off his presidency.

The justices threw out Trump’s challenge to lower court rulings that had allowed lawsuits to go forward alleging that he violated the Constitution’s emoluments clause by accepting payments from foreign and domestic officials who stay at the Trump International Hotel and patronize other businesses owned by the former president and his family.

The high court also ordered the lower court rulings thrown out as well and directed appeals courts in New York and Richmond, Virginia, to dismiss the suits as moot now that Trump is no longer in office.

I think they basically said it doesn’t matter anymore because Trump is no longer president.

They said it doesn't matter whether he violated the clause or not. He's not President any more so get over it.

Possibly Roberts is sending a message that going forward with an impeachment trial is moot because President Trump is no longer the sitting president?

I too am confused, but the way I read the article it appears the lawsuits can proceed?

Just imagine if they applied the same “illogical reasoning” to the Clinton Foundation.

The SC ruled that the issue is moot since Trump is no longer president. Hard to see how John Roberts can avoid doing exactly the same thing for the farcical impeachment Pelosi will be sending to the Senate.

I think your correct, this is the legal argument that Professor Dershowitz has been making, Impeachment is to remove a sitting president for a crime committed while in office.

So it is good to see the Scalia philosophy of interpreting the Constitution as it is written is the first best approach when it clearly speaks on a subject.

The court really chickened out on this one. There is no law that says a President cannot make money while in office.

FWIW - I looked at some other reports online and it says the suits themselves have been dismissed as being irrelevant.

I am sure they will use the same legal logic on the lawsuits about election fraud and unconstitutional actions by state officials.

Methinks this a "fig leaf" to cover his utter distaste and loathing for commoners whose only representation in recent times has been Trump.

This was done to make SCOTUS look impartial when they will refuse to intervene on Trump's behalf with the majority citing something about "Separation of Powers" and "Impeachment is a purely political matter", thus allowing the Senate to Convict and bar Trump from running for Federal office again.

My guess is that Alito and Thomas and possibly Barrent will be the dissenters when SCOTUS allows the trial to go forward.

The court doesn't send such messages. It ruled on the issue at hand.
