As Donald Trump’s second impeachment trial begins today, not enough attention has been paid to the fact that Chief Justice Roberts will not be presiding.
Senate Democrat Richard Blumenthal, a lawyer, former federal prosecutor and member of the Judiciary Committee, believes the Chief Justice should preside.
Elizabeth Warren adopts the far more aggressive position that the Chief Justice must preside as part of “his constitutional duty.” For good measure, she adds, “I can’t imagine why a Supreme Court justice would not do his duty.”
Senate Majority Leader Chuck Schumer presents yet a third constitutional argument. He claims that the Constitution commits the decision as a matter of choice to the Chief Justice: “The Constitution says the chief justice presides for a sitting president. So it was up to John Roberts whether he wanted to preside with a president who is no longer sitting, Trump, and he doesn’t want to do it.” Senator Leahy, who has been designated to preside, agrees that the Chief Justice would be “the first choice.”
All of these assertions are manifestly incorrect and for reasons of considerable bearing on the proceeding.
Working in order, Blumenthal does not pretend to a legal argument. He wants the Chief Justice to preside for its beneficial public relations impact. The world’s greatest deliberative body merits better than this, especially given Blumenthal’s senior status on the Judiciary Committee of all things.

Sue SCOTUS!
“justice(4Malta)” Roberts never has done his duty
except to those that made him rape and murder children
for HIS CHILDREN taken from others (how?)
lied about ObamaCARE.
demanded Trump be removed.
Obeys Malta.
Micturates on America, prn.
Roberts playing the role of Pontius Pilate and washing his hands of it.
Yep.
Reportedly Schumer asked Roberts about the legitimacy of the Impeachment after office, and SCOTUS considered such a charge would be illegitimate and would not be a party to it. Democrats proceeded at their own risk.
Now they can all be removed from office for high crimes and misdemeanors.
I think Roberts saw three issues.
1. There would be an appeal and serious problems over the legit nature of doing this to a sitting President. Once it came back to the Supreme Court, Thomas would have dumped a ton of criticism onto Roberts about his handling of this.
2. If you dumped onto Trump this idea of inciting a riot...you’d invite every single President since Washington to be dragged up and charged with ‘inciting’. Pelosi alone....probably thirty occasions that she’s incited people to riot.
3. He probably saw the capital police as a door-guard operation and part of the reason why things went out of control on the 6th.

Why don’t we have a written statement from the Chief Justice? Come on man! Tell us why you won’t preside over an “impeachment” trial!! Of course we know it is a political assassination trial. They are going to spew their continued lies and their media whores will repeat their agreed upon talking points. The senseless public will repeat the lies so everyone on the left is on the same page. Meanwhile those of us who follow the Constitution will ask, ‘why are you performing an unconstitutional “trial” when you swore an oath to uphold the Constitution?
One hopes the videos of police, well people wearing the uniform at least, waving people into the capitol building will be shown.
“Now they can all be removed from office for high crimes and misdemeanors.”
Sure, just who will be doing that?
Amen. This AH should be censured and recalled. The NJ demonrats have no scrupples. (I guess qualifing demonrats was unnecessary)
Those senators who are orchestrating this unconstitutional action should themselves be expelled. They are violating their oath of office by violating multiple amendments of the Constitution. But then again, the law doesn’t matter to them because they are ‘senators’ from the upper chamber where laws don’t apply!!!
I think Roberts knows that when it goes to the supream court anything he did with impeachment would be over turned...If Roberts thought the supream court would back him up he would be a part of the kangaroo cour.t
LOL, you seem to think we our a nation of laws.
And therein lies the problem.
