Charles Hurt: After Impeachment Farce Ends, Next Comes 14th Amendment
Breitbart ^ | Charles Hurt13 Feb 2021 | Charles Hurt

With the result of the second impeachment charade a forgone conclusion in Washington, let us now turn to the final partisan tool remaining in Democrats’ torture closet: The 14th Amendment.

This amendment allows Congress to banish from future federal office any current or former politician deemed by congress to have “engaged in insurrection.” Its adoption after the Civil War was designed to prevent officers or political leaders of the Confederate regime from being elected to Congress or the presidency.

In a normal world, it would be impossible for Congress to punish a man for engaging in “insurrection” after Congress had just acquitted the same man of engaging in the same insurrection. Or, as Senate Majority Leader Chuck Schumer recently called it on the Senate floor, “inciting the erection.”

But this is Washington and the man in question is former President Donald Trump, whose Latin name is Swampus Horribilis.

Gripped by hatred and fear of their long, partisan nightmare, Democrats in Congress today seek “unity” by heaving Mr. Trump into the dustbin of the Confederacy. In this name of “unity,” what precisely does that mean for the 74 million current Americans who just voted for this modern-day Jefferson Davis?

To be sure, it is a rusty, gnarly hatchet. But when all you have is a hatchet, everything is plump flesh and brittle bone. And hack away they will!

In the name of “unity.”

No one has ever accused Democrats in Washington of being particularly steeped in history. But even for them, this assault on history — and common sense and decency, for that matter — strains absurdity.

Wouldn’t Amendment XIV, Section 3 require that Trump be convicted by a federal court or military tribunal to be banned from future office by Congress?

I’m aware that the Marxist Dumb Dumb-O-Crats are turning this question into a rhetorical one, but I thought it was still worth asking.

PING!

Funny the retribution over fallen Confederate foes was the origin of the 14th. Had to do with raw feelings in a civil war back then. Maybe Dems want to rile that up now.

But ahead of it will be the vicious woman prosecutor with Trump’s financial records and tax records in the Southern District of New York.

Since Trump first announced he was running for office till now, it’s just been constant constant constant constant constant harassment and violence by the neo-Marxists. And they have the gall to say the Capital protest was because of Trump? Like HELL it was! It was we the people who put up with 4 years of BS saying enough is enough. The election coup was the final straw. We put up with EIGHT years of Obama screwing over this country and excuse me, they couldn’t even put up with one day of Trump? And now they want to dictate to us who we can support in the future? F these damn domestic enemies!

The Fourteenth Amendment should have been used to ban the entire Democratic Party.

What are they afraid of? That they won’t be able to cheat their way to victory again?

Just tell the communists that they are wrong about the 14 Amendment.
It's another one of those “trick” Amendments that doesn't really say what it sounds like it's saying...you know, like the 2nd Amendment.

I think you may be on to something. Feelings about the Civil War. Feelings like, "You Republican bastards came and took away our slaves! We'll never, ever forgive you! But we'll figure a way to get the darkies back in chains. Maybe not chains on their arms and legs. It may be chains on their souls instead of their wrists but we will own them again, you Republican garbage."

Then came the welfare state, proving that they meant what they said.

Democrats once again applying the 14th amendment in a manner in which it wasn't intended to be used.
Section 3 was meant for those who had fought in the Civil War, not to be used after the fact as the Democrats are doing now.

You want proof? A law was passed (and revised) to address this issue.

§2383. Rebellion or insurrection

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

(June 25, 1948, ch. 645, 62 Stat. 808; Pub. L. 103–322, title XXXIII, §330016(1)(L), Sept. 13, 1994, 108 Stat. 2147.)

Democrats are STUPID!
I take that back. They are LAWLESS as their desire to use the 14th amendment instead of USC 18, §2383 indicates.
They want to apply something that is inapplicable instead of relevant law.

Yeah, yeah, I know!

They want to taint him with racism by using the 14th Amendment through it's association with slavery.
That's secondary.

It's still a lawless action.

And Charles Hurt is an idiot as well for following up on this drivel!

Ten minutes and I was able to find and post the actual, relevant law.

Hurt is a TOOL!

This [Fourteenth] amendment allows Congress to banish from future federal office any current or former politician deemed by congress to have “engaged in insurrection . . . "

With all due respect, the amendment does not say that.

The bar turns on the issue of whether the office holder has committed the act (insurrection); at the point where someone sues a state election official to bar a federal office filing on the grounds that the filing party has committed insurrection, the issue is on the table as to whether or not he did so.

Even if, in a properly initiated impeachment, Congress found Trump had committed insurrection, that probably does not resolve the issue.

The only power Congress has on the issue under the 14th Amendment is to remove the bar if one exists.

Interesting. I wouldn’t put it past them to ignore double jeopardy and raise simultaneous cases in every blue state to do just that.

Assassination still isn’t off the table, but they’d prefer a living man driven to penury to a dead martyr.

And that is why democrats and their media allies have been calling this an “insurrection”.

Had to do with breaking the political will of the south and handing power they hoped to blacks and a few southern GOPe ....now this was GOPe then...lol...funny really

1876 when Hayes who did not win the popular votes but was basically given the electoral votes politically thru what was eventual compromise and GOPe chicanery

Dem Samuel Tilden gave up his rightful claim because Hayes and moderate GOPe and Dems agreed that reconstruction would end and troops would be removed

The racial republicans ...basically former abolitionists lost....whites in the south reclaimed power

The radicals hoped to own the black vote which was mostly in the south and a majority in a number of states ...forever

They lost that though blacks did continued to support GOPe till I think two things
Hoover and one thing he failed to do....I forget....it was a specific decision ....and of course FDR who captured depression era poorer whites and blacks

There are some similarities to then and now except the parties are somewhat but not completely reversed

By 1876 both parties had more moderates in them than in 1860 or 1868 thankfully ....a forced occupation of the white south in perpetuity would have been a tall order

Talk radio when canonizing the GOPe really butchers this era.....a disservice to really understanding it all

It was a different time

What we face now however is all new

An upheaval in very very quick order of the complexion of the nation and culture....which is historically disastrous anywhere it’s tried most often by force not voluntarily imposed like we’ve done and are doing

And generations of Americans younger than boomers are getting more and more leftist

And the left controls basically every institution sans the votes and they steal those

It’s crazy

Imagine in 1860 no newspaper except pro slavery expansion ones

Or only abolitionist outlets

Today John Brown would have been lauded across the board by media regardless his killings like modern media lauds ANTIFA and BLM as peaceful protestors....”today southern artillery fired upon United States Ft Sumter in what was mostly a peaceful fusillade”

Or “today in New York city hundreds of negreos were hanged from lampposts in draft riots across the city in mostly a calm and peaceful manner as waltzes played and silk pillows were placed over their heads”

Our media is lost ....absolute goners

Honestly I think the divide is more profound with less shared views between each side...in 1860 the free populace north and south was nearly all white Europeans and most from The British Isles with some Dutch and German and French in Carolinas and Louisiana and gulf coasts to Pensacola

But the factions are too fat and happy...to got to arms

These divides especially stealing a landslide would have wrought conflict way beyond that silly capital bum rush

The future is grim...I just don’t see that our 75-80 million have anyone to represent us so far....this impeachment farce has neutered Trump for now

Just like GOPe wanted then for southern whites and now for white trump supporters

Which is why I’ve never been rah rah GOPe like so many here

They simply betray us every time going gets tough

Cant say the Dems treat their base that way

We need an alternative

This is so utterly insane, I don’t see how it could possibly stand up in court. It’s well beyond being a joke and is just another sign of the Dems’ full-fledged embrace of authoritarianism and their efforts to eliminate political dissent.
