Today’s exclusive report — being co-published in The Guardian and Jacobin — breaks some big news about Andrew Cuomo helping a major corporate donor potentially immunize itself from future prosecution.
As Governor Andrew Cuomo faced a spirited challenge in his bid to win New York’s 2018 Democratic primary, his political apparatus got a last-minute boost: a powerful health care industry group suddenly poured more than $1 million into a Democratic committee backing his campaign.
Less than two years after that flood of cash from the Greater New York Hospital Association (GNYHA), Cuomo signed legislation last month quietly shielding hospital and nursing-home executives from the threat of lawsuits stemming from the coronavirus outbreak.
Critics say Cuomo removed a key deterrent against nursing home and hospital corporations cutting corners in ways that jeopardize lives.
Since receiving large hospital and nursing-home campaign donations, Cuomo has supported other legislation backed by those industries. His administration backed New York’s first increase of Medicaid reimbursement rates in more than a decade, which is expected to deliver a windfall to private health care facilities.

The analysis found that “of the ten states with the highest fatality rates, eight have corporate immunity and represent 93 percent of all fatalities, or 63,187 deaths.” The report also says the data show that “states with corporate immunity saw more than 3 times the absolute number of fatalities than states without such immunity. The average rate of death per state is 7.5 times higher in states with corporate immunity than states with no immunity for corporations.”
In all, the report concludes: “77 percent of total deaths come from states that gave immunity to corporations who owned nursing homes and healthcare facilities; moreover, 76 percent of total nursing home deaths come from states that have legal immunity status for these facilities.”
The legislation didn’t just give the nursing homes immunity from being sued - it gave Cuomo immunity from being sued through the nursing homes - by families who might sue the nursing homes AND Cuomo due to his directive that forced the nursing homes to take in covid positive patients.
If the nursing homes could be sued, they would simply point (rightfully) to Cuomo and say, HE FORCED US TO DO IT!
So, if the nursing home CANNOT be sued, neither could Cuomo in spite of his directive.
How does he grant immunity to whomever he chooses? Is he the emperor?
It (the immunity) was inserted into a bill being voted on - when no one was looking, and it had no connection to the bill, and not one of the elected clowns caught on - because they don’t read anything that they sign into law.
So, basically, he’s a hit man.
