No, because that would mean that the Constitution means something anymore. It does not. If he in fact said what is claimed he's a dumb ass.

He couldn’t be court-martialed for the death, but if they decided he committed perjury, they could try him for that. I don’t know if he actually testified at his trial, which would be necessary for a perjury charge.
