U.S. bankruptcy judge rejects NRA bid to reorganize in Texas

The National Rifle Association cannot use bankruptcy to reorganize in gun-friendly Texas, a federal judge in Dallas ruled on Tuesday, handing a defeat to the influential firearms rights group that is facing an effort to dissolve it in New York state.

U.S. Bankruptcy Judge Harlin Hale's decision, following a trial over the legitimacy of the NRA's January bankruptcy filing, means the group will remain incorporated in New York.

Letitia James, New York's attorney general, had last August filed a lawsuit seeking the dissolution of the NRA, which she accused of corruption and misspending.

"The question the court is faced with is whether the existential threat facing the NRA is the type of threat that the Bankruptcy Code is meant to protect against," Hale wrote. "The court believes it is not."

If it’s incorporated in New York and they declare bankruptcy then it stands to reason it’ll play out in New York.

My wife was a bankruptcy attorney for almost 40 years, it has nothing to do with the Judge being a rat, it has to do with where were the debts incurred and where was the NRA located at the time of the debts....plus some states have exceptions to the Federal Bankruptcy Code.

For example Florida has an exemption where creditors can’t attack someone’s homestead, so what often happens is some rich New Yorker want to file bankruptcy and they take whatever capital they have left and purchase a house in Florida and declare that their residence...

The late Baseball Commissioner Bowie Kuhn did exactly that, he paid cash for a huge house in Florida, filed for bankruptcy in NY and was allowed to keep the house....

Harlin Hale clerked for a Rapin Bill “judge”, and was appointed in November 2002.

If this was "Planned Parenthood" a magical loophole would be found, or laws have been solely crafted to punish political opponents.

Remember when Lois Lerner got thrown in jail for illegally using the IRS to target conservatives .... of course you don't because she was allowed to do it with impunity.

Ha! If that was really the concern there would be lawsuits seeking the dissolution of thousands of New York based companies and organizations.
