The DOJ’s argument concerns Trump’s qualified immunity, as he was acting in his public capacity. If the DOJ is allowed to intervene, Trump is not personally liable, at least that’s my take on it. They may very well reach a nasty settlement which attempts to paint Trump in as negative light as possible, but without personal liability. At least that’s my take on these pleadings.
