No, they are not in violation of HIPAA.
They would love to lose some American workers and import Asians for their jobs. What happened in tech is happening in the financial sector; when Occupy Wall Street started and laid-off American workers were demonstrating outside their NYC office buildings, you could literally see the coolie scabs filing into the buildings behind them on the news.
They don’t need their clients’ money.
That is the dilemma for employers, and a common solution seems to be “make life miserable for the unvaccinated, but don’t require it”. I suspect that is legal advice they believe will cover them in court.
I’m curious to see what colleges here in NJ intend to do in the fall; many stated months ago that they’d require vaccination, and wanted everyone “live” on campus (so remote may not be offered). I guess the faux economy these schools bring to urban sh!tholes is more important than dealing with some students walking away or going to schools in other states (already a huge problem in NJ).
No need to force people to get vaccinated for a far-from-lethal disease like this. Let the vaccine prove itself over time.
It must, because if they believed the vaccine was effective, then there would be no danger to vaccinated employees from contact with the unvaccinated. What exactly does MS know about the effectiveness of these vaccines and is unwilling to acknowledge?
Don’t we also need to concern ourselves with blood supplies using this unproven technology? Are blood stocks with different vaccine traces compatible with each other? Should that be a consideration for transfusions in emergency situations?

Risk adverse fortune 100 companies don’t make legal mistakes that often. They’re not going to in this case. They’re already doing it.
I expect to lose my job for the same reason in about a week.
