Sounds like there is no effective outside owner to sue.
There is the condo association and a first class-action suit has already been filed against them. Not too likely their insurance goes deep enough for this loss of life, however.
The board members are probably indemnified against claims if they are volunteers, so the association's insurance company would be the primary point for any claims.

People will own condos for years and refer to “the association” as if it’s some entity not connected with them that tells them what to do. They never really understand that they ARE the Home Owners Association and it’s their job to make all the decisions about the entire property.
So, who are they going to blame?
I’ll bet they attempt to go after any municipal authorities that can be tied to having prior knowledge of structural problems...not that they would have much luck there.
