Divided Supreme Court sides with landlords, lifts part of New York eviction moratorium

The Supreme Court on Thursday night lifted New York’s pandemic-related ban on residential evictions, siding with a group of landlords who said their rights were being violated.

The short emergency order was opposed by the court’s three liberal justices, who noted the moratorium was scheduled to expire at the end of the month.

“We must balance against the landlords’ hardship the hardship to New York tenants who have relied on [the law’s] protections and will now be forced to face eviction proceedings earlier than expected,” wrote Justice Stephen G. Breyer. He said ending the moratorium early “may lead to unnecessary evictions.”

Amazing how pols or judges could EVER just declare landlords pay everyone's COVID bills. According to the state of NY and the CDC, anyone/everyone can just stop paying rent for any reason whatsoever - or no reason at all.

The property owners have no rights under the new system - they just get fk' over while they watch their tenants spend their rent money on Chinese Amazon products.

Meanwhile, our BROKE-D**K supremes prattle-on... while absolute lawlessness continues.

No one court has given two craps about lardlords hardships.

They have been targeted by government to go bankrupt. They have not had any forgiveness granted on their mortgages and payments.

They want to wipe out as any property owners renting to others, as possible. Then the banks can take over their properties and resell them, and/or government can take over certain real estage they wanted all along, and in the process they shrink the middle class by wiping out the landlords.

If you read the entire article then this is hardly a victory for landlords. In fact it is not even clear if there any real path to get rid of tenants. The USSC is also completely ignorant arrogant. They think landlords can just get money from the government. And what about landlords who want to sell and get out but they can’t because they can’t get rid of the tenant. And what about tenants who are destroying the property.

The USSC ignores the 4th and 5th amendments. The justices are nothing more than a bunch of liberal lawless goons.

Then you have idiots like Breyer Who are so corrupt that they don’t even understand that NY will extend the ban over and over again as they have done over and over again so far. Guy should be replaced with a box of rocks.

We just saw what happened when Trumps pick used that argument with the CDC. That it was about to end anyways so.... No up and down ruling. The left laughed in his face and extended it again. Lazy gutless SOB that Mr K. He should be impeached already.

“Moreover, the challenged law will expire in less than three weeks,” Breyer wrote, saying “such drastic relief” is not appropriate at this time. Justices Elena Kagan and Sonia Sotomayor joined his opinion.

“For these reasons, I would not grant relief now, and therefore respectfully dissent. Of course, if New York extends CEEFPA’s provisions in their current form, applicants can renew their request for an injunction.”

Lower federal courts rejected efforts from New York landlords to allow evictions to resume and the state had urged the justices to follow suit.”

Can you imagine that the USSC admits that a law or action is illegal and yet it should be allowed to continue for a certain length of time. This is exactly what MR K did. What a completely lawless legal philosophy. How totally corrupt. Every justice should demand an immediate end to lawless actions or they sure don’t belong on a court. They should be looking into forcing NY to make restitution to the landlords who were screwed by that illegal action.

Of course as I said before. If they had any interest in the constitution and the law then they would end all moratoriums by citing the 4th and 5th amendment.

I've had to get pretty creative to force the deadbeats to vacate the premises. I'll haven't failed yet and I'll never confess how it happens.

I know there is a lot of money involved, but is there a point where you just say screw it, stop paying taxes and wait for the City, State or Bank to take over the building? Let them evict the leeches they created. Bank the tax money, bank the mortgage, buy a house in Texas and bolt. Can that be done?

And here is one more for those corrupts saps that sit on the USSC. Did you know that a tenant can move out and go live somewhere else. But leave a bunch of stuff and not tell the landlord they are leaving. Then 3 months later they can decide to come back. During that 3 months they still cannot even be evicted.

Did you hear the one recently where a tenant in NYC was behind before covid. They owed tens of thousands of dollars to the landlord. The tenant then sub-rented the apartment and collected the rent from a third party. They pocketed all the rent and gave the owner nothing at all. Still going on right now. The landlord cannot evict. It is pretty much over for him. He was going to leave the place to his family. But he is going to lose it now. I think Tucker had him on.

Peoples heads are in the clouds if they cannot see how crazy this is.

Until the day the property is legally transferred out of the landlords name then the Landlord is responsible even for the tenant. All repairs and such. If the toilet stops flushing the the authorities can go after the landlord. The landlord is not only going to lose everything. They are also a slave to the tenant.

I thought the same, but nobody actually died and all three branches of government are still there.

It’s just suddenly legal now for hirlings at the CDC (or wherever) to single out landlords (or whoever) for financial ruin.

On the new declaration we need to add that in with all the other stuff.

“They have purposefully deprived landowners of property for the benefit of their political supporters.

They have allowed laws they admit to be unjust to remain in force.

They have used the courts to wear down political opponents instead of seeking justice.

They have imprisoned protestors for months on end with no trial.”

The feds are catching up to George III with their intolerable actions.
