I am very disappointed in the new breed of conservative judicial activists who think that we should abandon the principles of originalism and textualism so forcefully championed by Scalia and impose our will through the courts rather than the other branches of government. That is what Dem judges do.
This is about the law, not whether you think building this thing is right or not. I happen to think the whole plan stinks, but deciding that policy issue is not for SCOTUS.
No it doesn’t change your statement that they all suck. We can sit here and say they suck, without regard to thoughts of what the alternative would have been. I was wondering what Trump should have done instead of choosing these 3 nominees who all got narrowly confirmed.
And we all have to see how they rule on future cases. Opinions of these judges can change based on that.

I agree with you. I think we are outnumbered. It seems many on this site think she ruled as she did to somehow curry favor with liberals and Obama. They seem to think that she did not consider the legal issues involved. In any event, she is thought to be too liberal by many here.

Freerepublic posters are getting bad in the area of emotional response rather then an intellectual response. I dont know enough about the issue on this to make a judgment about it being a good or bad judgment. The fact tha its about Obamas presidential library should not have a bearing on the judgment. Any judgment on this case will be sighted on other cases so its important that the judgment is not about one’s politics. in fact all judgments in court its important that its how the law was written and what the intent of the law. The fact that people dont understand this is destroying this nation....We are a nation of laws not feelings.
