To be sure there are agonizing behaviors as a result. I question whether more laws and law enforcement are the answer.
I don’t watch videos often. But we spent a week with them on a cruise, and every time we saw them they appeared to be decent, respectful, respectable people.
If one is sober one should be able to remember to:
NOT answer questions
NOT agree to any field sobriety tests, including HGN
DO insist on a calibrated breath analyzer or a blood test
If one is plowed one won’t remember any of this, and that’s fine, go directly to jail.
File a big fat law suit.
Oh, yeah. Thank G-D for dash cams. Been using them for years.
As a group, they are not on your side.
I am not saying otherwise - but Mrs. West did screw up in her driving on camera, literally anyone doing what she did on video in front of a cop is going to get pulled over for potential DUI as she’d given them probable cause.
Also, Mrs. West’s actions or inactions shouldn’t (and in my mind don’t) reflect on her husband. Nor should they for any thinking individual.

You are forgetting perspective and camera lens distortion. In any case, the closer SUV was not driving mostly on the shoulder, so she gave them probable cause. She violated Texas Transportation Code section 545.058.

Unfortunately, people being idiots were actually killing a significant number of people in Texas while texting, so laws and law enforcement ended up being the answer used.
Every one of them.
And honest police officers will tell you so.
They may be the nicest guy in the world but once they put on the uniform they run by a set of rules that are hostile to even the most law abiding citizen.
Rule one is that if you come to my attention you are presumed to be in the wrong.
There is no rule two.
I used to trust cops in general.
Now my default is to distrust cops.
Bullies. If a cop isn’t a bully, he/she is the exception.
This hasn’t always been the case, but times have changed.
She needs to sue the individual cop and force that person to suffer consequences.

You are supposed to have one long exhalation. Repeated short puffs like that will result in the unit erroring out. Experienced drunks will sometimes do that to avoid getting busted - not saying she is experienced or that she was doing it on purpose, just pointing out that it is a known behavior.
Pretty good chance that they didn’t know it was her until she wandered onto the shoulder and they pulled her over. She also wasn’t terribly cooperative in following the instructions to pull over - stopped in the middle lane, etc., etc. Yes, the officer screwed up the field sobriety test, but Mrs. West didn’t do herself any favors either.
