It should also be easy to find out - just check their onboard computer system’s logs as to when they ran the license plate.

This happened to my husband. Pulled over for “drifting” in his lane. Declined the roadside test; requested the test at the station. Blew a zero there; no DUI. The officer told him he “wasted his time.” (!!)

I saw the video of her arrest, and it was pretty clear to me she wasn’t intoxicated. However, I totally understand the traffic stop - she was all over the road. She was either screwing around with her phone or is the shittiest driver ever.

Due to shattered ankle, can’t do “the walk.”

At the station no indication of intoxication so release would be in order. Ticket would be okay.

Thing is, sources/friends in the DPD say the officer acted wrongly because once at the station it was clear she was not intoxicated/high and should have been ticketed and released. They say he is not that bright and has a sensitive ego and according to them, DPD was in cover-up mode that night.

This is not a court. It probably will get to that.

I traveled for a living (outside sales, sales management). In 40 years over 2 million miles, I received 2 speeding tickets (one in known speed trap). Never had an accident and at one time I covered 11 states for the company.

Lots of 15 hour days.

Don’t miss the driving. Only time I go out of state now is to see my daughter on the East Coast.

In my life, I can only remember being stopped by a rude officer 2 times. Did not get a ticket either of them.

I’m 73 now, but am still very active. No health issues. Only health problem is I hate Totalitarian freaks. They would put me in jail in DC.

I wouldn’t be surprised if he got the Barney Fife treatment where he was directed to just arrest everyone that he thought failed the field sobriety test, due to past embarrassments.

Also, I don’t think DPD does tickets for DUI any more. It’s either an arrest and detention or clearance and you are free to go. There have been too many incidents where someone legitimately DUI was given a ticket and the car was impounded where the person just went and got another car.

I’ve heard similar about the officer from friends in DPD and DFD. However, I’ve not heard they were in cover-up mode and the assertion of same would be offset by the fact they released the entire video pretty quickly.

One tactic that used to be valid, both for people wanting avoid incorrect field breathalyzer readings and for people that were actually DUI was to decline the roadside test but volunteer for a blood draw test. It takes longer and there is usually a wait at the hospital, so the DUI people would get a chance to sober up a bit more before the test would take place. The non-DUI people would be more sure of an accurate test (mouthwash can peg a breathalyzer, even though you aren’t drunk.)

This has been offset in part by modern DUI checkpoints where they actually have an RV with a medic and a magistrate who can order blood draws, which take place instantly on site. Another concern is what the government does with your blood after the test.

I ride (non-Harley) motorcycles. Sadly I cannot say I’ve had the same experience even when completely law abiding.

This *should* go to court, honestly. She gave them *plenty* of probable cause to pull her over, so that part should be fine, but the field sobriety test was bad.

Sad that could happen in Dallas, especially not in Austin.

Remember that Democrat DA from Austin, I believe, who, if I recall correctly, was clearly intoxicated?

West deserves a seat in congress. He was so effective against the left that they specifically redistricted his constituency seat in Florida to get rid of him.

I would love to see him have a go at Twitchy Mitchy in the Senate. Of course Mitch would never fund West, he is anti RINO.So far, PDJT has not replaced McConnell as the party’s Kingmaker in the Senate, witness the debacle in Georgia thanks to McConnel who would rather lose than see a Trump supporter in the Senate.

The battle will continue.

If she had ZERO blood alcohol, it should have shown Zero.

Like many tools, the breathalyzer is not perfect and there are conditions required for it to work properly. The test subject has to make a constant steady exhalation into it to work.

Also, there are conditions under which a person with a BAL of zero will be detected as having a much higher BAL. There is a MythBusters episode about that.

This is very relevant and claims of editing dead-time irrelevant portions of the tape are disingenuous and misleading.

Cover-up mode may not have been the best language, but what was meant was the DPD that night was to close ranks and blindly take the officers word without reviewing the entire video, first; i.e., “covering-up” what they knew to be relevant facts.
