If that's the case, then charge her with "distracted driving" or whatever the equivalent is in Texas. DUI charges should be for those who are actually driving under the influence of drugs or alcohol.

Thing is, it is illegal in Texas for a driver to use a handheld phone while in motion. The usual way this goes is the cop can’t see the device use but can see the failure to maintain vehicle control. They pull the car over, the driver has dropped/hidden/tossed the phone away from them to avoid the phone use charge and denies they were using it. Well, if you weren’t using a phone, you must be drunk, so here’s your free DUI exam and charge.

Amazing how many near accidents I witnessed (and was almost involved in) because some idiot was too preoccupied texting their BFF instead of concentrating on their driving. What's crazier is more often than not these idiots are WEARING THEIR DAMNED MASKS like good obedient little children.
