US Appeals Court Reinstates Texas' Heartbeat Abortion Law

A federal appeals court Friday night quickly allowed Texas to resume banning abortions after heartbeats have been detected, just one day after clinics began racing to serve patients again for the first time since early September.

A one-page order by the 5th U.S. Circuit Court of Appeals reinstated the nation's strictest abortion law, which bans abortions once cardiac activity is detected, usually around six weeks. It makes no exceptions in cases of rape or incest.

"Patients are being thrown back into a state of chaos and fear," said Nancy Northup, president of the Center for Reproductive Rights, which represents several Texas clinics that had briefly resumed normal abortion services.

I don’t understand all this back and forth.

The Supreme Court had voted earlier to allow this law to go into effect.

But then recently, a lower federal court issued an injunction against it.

And now an Appeals Court has reinstated it.

Since the Supreme Court already ruled, how can there be legal actions getting injunctions in these lower courts in the first place?

I understand the Supreme Court action did not preclude further legal actions, however, I thought that action meant the law was in effect even as lawsuits were brought. The Supreme Court did not rule on the merits. Any such lawsuits on the merits would be argued first in lower courts.

My daughter and I came up with a solution. Make abortion legal with required sterilization as part of the procedure. That way a woman can only murder her child one time.

Neither do I, however I believe that the murderous Marxist mantra of the left "My Body, My Choice" is finally failing, and ordinary citizens believe that a preborn baby is a living individual human being.

The other aspect is Wording Of Law in which ordinary citizens are starting to realize that much "Law" is actually trick wording by crooked lawyers and activist judges to accomplish exactly the opposite of the "Laws'" stated intent, or to make a good law unenforceable.

Add selective prosecution and selective enforcement by crooked prosecutors and crooked cops, and you have today's Legal Arena where Might Makes Right, the exact opposite of what the Rule Of Law is supposed to be.

All experts just after the Texas ruling were saying it was a well written law. I think that’s the problem these ‘people are going to have.

Grimly funny but the abortion supporters see it all as so called “family planning” and “Planned Parenthood” in which all the unwanted babies are murdered until one that is around at the just the right career path point for the woman, and that baby is allowed to live.

In another form, that’s what the in vitro fertilization system does. I heard that they start with a row of eggs and then choose one viable embryo egg candidate to use for the woman and the others in the row are killed off. Thus, several killings in a sense. Only heard that a few weeks ago on a Catholic discussion show.

The Obama appointed “Judge” said that the Texas law was a work around for the “Constitutional right to an abortion”.

Can someone please cite, within the Constitution, wherein someone has the right to an abortion, and it’s plainly stated? Like the “Right to bear arms shall not be infringed upon”. Better yet, do Judges have to actually read the Constitution anymore?

That is accurate. For every baby conceived by IVF. it’s brothers and sisters were murdered because mommy has a “right” to have a baby, even by immoral means.

YES - THIS! If we can’t the whole barbaric process completely banned then here’s the deal -— You want an abortion - you’re included in the termination result. One step farther - include the sperm donor in the sterilization process.
