EZpass records have just demonstrated that Kerik was not in DC at the time of a meeting described in his subpeona. I will not be surprised if the Soviet stasi style committee excuses Kerik from coming.

Exactly - and these subpoenas are not necessarily for public testimony - so if Kerik or others do some damage and kick some teeth - the public will never see it.
