Sotomayor compares fetus to brain dead person, says fetal movement doesn't prove consciousness

Supreme Court Justice Sonia Sotomayor rejected the idea that a fetus that has the ability to move and react to pain is a human life that should be protected from abortion.

"Virtually every state defines a brain death as death," Sotomayor, appointed by former President Barack Obama, said during oral arguments in a potential landmark abortion rights case Wednesday, as the state of Mississippi defended an abortion restriction law that directly challenges Roe v. Wade.

"Yet, the literature is filled with episodes of people who are completely and utterly brain dead responding to stimuli," Sotomayor continued. "There's about 40 percent of dead people who, if you touch their feet, the foot will recoil. There are spontaneous acts by dead brain people. So I don't think that a response to -- by a fetus necessarily proves that there's a sensation of pain or that there's consciousness."

Sotomayor also said that she believes the idea that a fetus is a human life is a "religious view."

A misguided individual.

One could argue that the development stages of the fetus is what enables the potential for the development of human consciousness, but any argument that the development stages cause human consciousness are inaccurate.

Sotomayor is right: after abortion comes euthanasia. Pulling the plug on the brain dead would be just a start.

We have to be pro-life at every stage of life, because the other side is pro-death at every stage of life.

We have no proof Sotomayor is conscious.
Me, I’m not conscious when I’m sleeping, that would be a great time to steal my ballot and vote D, never mind terminate me.
As to pro-life position being a religious view, adhering to a religion is a moral view.
So pro-life is a moral view.
Without a moral view, what’s the point of a law?

By her definition the idea that any life has sanctity is a “religious view.”

That being the case it should be legal to kill anyone at any time for any reason.

Medical tests must be done to declare one clinically brain dead. EEG for brain waves. Ice water test etc. (Do they still perform that?)

Does she believe it’s okay to end the life of anyone non responsive to stimuli? Regardless of other medical findings?

Fine legal argument there. She should have shut her mouth. She undercut the very group trying to leave Rowe v. Wade unchanged with stupid stuff like that. Fortunately her argument will get lots of focus and blow itself up. It will make people think about it and that's going to work for anti-abortion groups.

This is a lot of jiggery-pokery to avoid saying that babies are inconvenient to the religion of feminism because they cause a brief interruption in their quest to avoid power and stuff.

The 15 weeks in the Mississippi law is actually longer than the first trimester proclaimed in Roe vs. Wade as the legal period for abortion on demand back in the day. It was dubious legal ruling then, but since the Mississippi law is actually longer, it may well hold up.

Though the baby killing cult of the far left religion will throw a major hissy fit.

Just curious if anyone really needs more than 15 weeks to discover they are pregnant. My wife pretty much knew in 6 to 7 weeks back in our newly married days when we were having intercourse every day or even multiple time a day. Of course, we actually wanted children, so maybe we were just weird.

But once upon a time it was perfectly normal to have intercourse with the idea that not only it would be a lot of fun, but that pregnancy might result. Anybody else remember such a time?

Interestingly in the autumn of 1953, Justice Sotomayor was unconscious for several weeks herself. Indeed, she was brain dead, by very her own criteria.

But her mother didn’t have her killed. So after some time passed she became conscious.

Back in an earlier life, I was involved with the neonatal ICU of a very accomplished teaching hospital. Worked with preemies so small they would easily fit in the palm of the hand of a tiny nurse .
