The Senate would just refrain from sending the president the paperwork on the final confirmation vote until Breyer has retired.

Has this ever happened before?

Even if it is legal, it surely must go against what the founding fathers intended. I don't see how the Senate can simply hold judgeships in reserve and play them like a Trump card.

They would be too frightened to go a day with one less lefty on the court.
