Arizona Attorney General Mark Brnovich on Monday issued a legal opinion that determines that the ongoing crisis at the southern border is an "invasion" under the Constitution – a move he says gives the state the power to take additional measures to defend itself.
In the opinion, Brnovich says that the definition of "invasion" contained under the U.S. Constitution is not limited to hostile foreign states, and can include "hostile non-state actors."
"The violence and lawlessness at the border caused by transnational cartels and gangs satisfies the definition of an ‘invasion’ under the U.S. Constitution, and Arizona therefore has the power to defend itself from this invasion under the Governor’s authority as Commander-in-Chief," Brnovich writes. "An actual invasion permits the State to engage in defensive actions within its own territory at or near its border."
The opinion comes after Republican state lawmakers and former Trump officials -- including former Office of Management and Budget (OMB) Director Russ Vought and former acting deputy DHS Secretary Ken Cuccinelli, both now at the Center for Renewing America -- urged Gov. Doug Ducey to use war powers to repel the enormous number of migrants that have hit Arizona’s border with Mexico in the last year. It would in theory allow Arizona’s police or National Guard to remove illegal immigrants to Mexico themselves.

That’s been the case for 30 years, but it has also been bipartisan policy through four Presidents, two of each party, before Trump tried to stop it.
They colluded to cheat him out of office to get it going again.
Has the AZ AG done anything about the Big Steal?
Ken Cuccinelli was explaining this recently (on War Room? Can’t remember ...). Per Ken, it is a Constitutional way to cut out the Feds (who are doing nothing, if not encouraging illegals) & stop the “invasion”. He was talking to border states about doing this - looks like the AZ AG was listening.

Article 4, Section 4
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
As you can see from the above quote, the Federal Government is obliged to defend any or all states from invasion. Any Federal Officer who fails to do so has violated his/her oath of office.
It took this idiot that long to see we were invaded, but after the cyber ninja reports proving election theft, he still can’t find anything. This guy has gone full blown stupid!

Texas has jailed some alien border crashers, but AFAIK Texas has no plans to deport them. According to this article the AZ AG wants AZ state officials to deport them. If that really happened Biden’s DOJ might sue AZ, claiming the US Constitution assigns that duty to the federal govt. (which would be ironic because the feds are not defending the border).

If it’s OFFICIALLY your job, but you won’t do it, you’ve “de facto” abdicated your Office, and the Authority vested in that Office, and it follows from that directly that it’s not usurpation for someone else to take up the slack and do the job you abdicated.
It took a lawyer to figure that out? Captain Obvious knew that on January 20 of last year.

The first action is to arrest all Border Patrol command and control. As POW’s they are not subject to lawyers or bail or freedom from incarceration.
