Judge Rules NY Attorney General Cannot Dissolve the NRA

On Wednesday, New York State Court Justice Joel Cohen ruled that NY Attorney General Letitia James cannot dissolve the National Rifle Association.

Cohen is a Justice on the New York State Court in Manhattan.

Reuters reported that Cohen ruled that James’ allegations of NRA financial malfeasance deal with private affairs within the organization, not with the group’s members.

He noted that James’ “complaint does not allege the type of public harm that is the legal linchpin for imposing the ‘corporate death penalty.'”

Cohen left the door open for James could continue to pursue NRA CEO Wayne LaPierre’s removal from the organization.

James released a statement in response to Cohen’s ruling:

Today, the court affirmed my office’s right to pursue its long-standing claims that fraud, abuse, and greed permeate through the NRA and its senior leadership. While we’re heartened that the judge rejected the NRA’s attempts to thwart most of the claims in our case against the NRA, we are disappointed that the judge ruled against the dissolution portion of the case. We are considering our legal options with respect to this ruling. We remain committed to enforcing New York law regardless of how powerful any individual or organization may be.

James’ lawsuit against the NRA was filed in 2020.

The case is New York v. The National Rifle Association of America, New York Supreme Court, New York County. No. 451625/2020. (The New York Supreme Court is a trial court, not the top of the NY judiciary.)

Good! There need to be limits on prosecutorial authority, regardless of how one feels about this particular case.

Me, personally, I left years ago because of La Pierre and his cronies not fighting hard enough for the gun rights of ALL citizens (he/they seemed to believe at the time, circa 2007, that retired police officers were somehow superior in their rights to those of us who never wore a badge - and I believed then and now that a retired police officer is otherwise known as a citizen). If La Pierre is guilty of stealing or misusing NRA funds, then he SHOULD be prosecuted. If not, then he either shouldn’t be prosecuted (not that this is an option with this radical gun-hater) or he should be acquitted of the charges after a fair hearing in court.

There’s no special treatment for ANYONE in our society under the Declaration of Independence or, more importantly, the Constitution - with the minor exception of the Congress being able to say whatever lies, slanders or other complete nonsense that they’d like to spout while on the floor of Congress itself. Otherwise, don’t commit the crime unless you’re willing to do the time: it is as simple as that.

Correct. Everyone excepting those serving or holding a commission in the armed forces are, in fact,civilians. With a few exceptions, (other than aliens, legal or otherwise,) all may be citizens.

Regarding WLP, and many members of the board, they just go. They have enabled the excesses of the past and seemingly want to wage a neverending campaign rather than win the war.

In a rule of law community, those limits are set by demonstrable facts and the intent of the law as expressed in it's written terms.
