AP EXPLAINER: Concern mounts as Melissa Lucio’s execution nears

HOUSTON (AP) — Nearly half of the jurors who sentenced a Texas woman to die for the 2007 death of one of her 14 children have called for her upcoming execution to be halted and for her to get a new trial.

Melissa Lucio, 52, is set to be executed Wednesday for the death of her 2-year-old daughter Mariah in Harlingen, a city of about 75,000 in Texas’ southern tip.

Her lawyers say new evidence shows that Mariah’s injuries, including a blow to the head, were caused by a fall down a steep staircase, and many lawmakers and celebrities such as Kim Kardashian, an advocate for criminal justice reform, and Amanda Knox — an American who was convicted of murdering a British student in Italy and whose conviction was overturned — have rallied to Lucio’s cause. Prosecutors, though, maintain that the girl was the victim of child abuse.

Lucio’s lawyers have filed various legal appeals seeking to stop her execution. She also has a clemency application before the Texas Board of Pardons and Paroles, which is set to consider her case on Monday. Republican Gov. Greg Abbott could also play a role in deciding Lucio’s fate. If put to death, Lucio would be the first Latina ever executed by Texas and the first woman the state has put to death since 2014.

The federal government has executed one woman since 1976. Lisa Montgomery, of Kansas, received a lethal injection in January 2021 after the Trump administration resumed executions in the federal system following a 17-year hiatus. The Justice Department has halted executions again under the Biden administration.

First thing is because of the source I have to question if that’s even true.

Second, if it is true.....it don’t work that way.

Harlingen and the surrounding area is (in)famous for corruption of all kinds-I don’t have any relatives living there, but my employer is from there, his family in law enforcement-he says there is no public official that can’t be bought if you have money and a thirst for venganza against an enemy-not exactly a place where I’d want to go on trial for anything...

If there is evidence to support reasonable doubt, then this woman certainly should have a new trial-as should anyone else in the same situation-that is how the law is SUPPOSED to work-maybe needs a change of venue, new expert testimony, etc-then let the verdict and sentence come-she is still either guilty or innocent...

....it is my understanding that lefties in California have passed a law that will permit abortion up to 28 days after the baby is born.

Effectively, someone will Murder the baby.

Anyone, please feel free to correct me on this if I am wrong. But, this is my understanding of this recently passed law.

If I’m right, then the left is already positioned to pardon, parole or commute adults murderers and they fight hard to do
it but in some cases with living babies they can legally kill them and they have fought hard to get the ability to do that too.

You are very correct to be suspicious about officials in Harlingen. I read somewhere else that the prosecutor of this woman is now in prison himself for crimes unrelated to this case.

I don’t doubt Lucio was a horrible mother, but the death penalty? Probably not.

I just saw this article on MSN and searched around unsuccessfully for any unbiased details of what happened in the case. Every single one of them sounds as if it was written by her defense attorney.

This is a good article. Especially this following paragraph.

Lucio’s supporters say many of the issues in her trial trace back to the head prosecutor in the case, Armando Villalobos. The former Cameron County district attorney recently spent several years in federal prison for bribery and extortion. At the time of Lucio’s trial, Villalobos was running for reelection against a challenger who criticized him for not thoroughly investigating or prosecuting charges of child abuse. Lucio’s attorneys say Villalobos wanted to make an example of Lucio to prove he was tough on crime.
