Just because you don't think they have the constitutional authority doesn't mean they don't. Alito didn't limit controlling abortion to the states.

Alito doesn't decide...the Constitution does. All commentary on the leaked opinion says that abortion goes back to the states. By the same logic, gay marriage does also.
