SANTA CRUZ – Much was discussed but no decision was made on Thursday by Santa Cruz Superior Court Judge Syda Cogliati regarding restitution for the vandalized Black Lives Matter mural in downtown Santa Cruz.
Members of the public were hard-pressed to find an open seat in the courtroom where attorney arguments continued for the two men accused of defacing the Center Street mural last summer. Brandon Bochat, 21, and Hagan Warner, 20, were arrested last July on suspicion of felony vandalism and were later charged with an additional hate crime enhancement and misdemeanor reckless driving.

At a previous hearing, Deputy Santa Cruz City Attorney Cassie Bronson provided the court with an estimated mural restoration cost of $103,000 to $114,000 and Cogliati advised that she was unlikely to order a reduced fine to get a less expensive repair. The defense has taken issue with this figure and the parties reconvened once again to plead their cases in hopes of reaching a definitive number.

Needed for evidence is a engineering report of the paint used and hazards to traffic and pedestrians for use of non DOT paint.
Painting a street with rollers and no application of heat indicates use of non DOT paint.

Also, there are standards used on how Street markings must be painted, including the lines on the edges in the middle of the road. By painting over those does that not create a traffic hazard? For example, if there is a head on collision, can I sue the city because the other driver wasn’t aware they left their lane because the lane markers were covered by the “mural?”

I’ve driven over one of the BLM “murals” in my area on a foggy night. Not having those lines easily visible was really weird and you had to constantly look right and left to make sure you didn’t veer out of you lane.
A fired of mine briefly worded for a large local entertainment venue. They had to fallow all the regulations to get permits to set up the everyday and temporary traffic patterns on the street leading to their main entrance such as signs, what types of cones, etc. that were used on normal days and special event days that brought large crowds. I guess if it makes you fell good, you can just ignore it.

If the paint used isn’t DOT approved, then someone needs to walk across that graffiti when it’s raining and “slip”, then sue the city.
