No. They can ask for a change of venue.


I am not a lawyer, but I believe the Constitution requires that the trial be held in the state or district where the crime was committed. I am not aware of anyone charged with a crime in DC whose trial was someplace else.

You can petition the judge for a change of venue.
There is a federal rule of criminal procedure that allows for it on the basis of the “fair trial” portion of the 5th amendment.

The same rule used to change venue in the Timothy McVeigh trial.
