If the Chief Justice is so concerned about limiting the scope of the judgement to the matter at hand, Roe itself should have been rendered moot as Norma McCorvey’s baby was born and adopted.

I am guessing that Roberts’ point of view may have prevailed in this case, but the leak made that impossible. The leak made certain exactly the opposite of its intended result.

But that is all I would say, out of adherence to a simple yet fundamental principle of judicial restraint:

This was judicial restraint - acknowledging and affirming the limits of judicial power is the very definition of judicial restraint. Roe v. Wade itself was certainly the farthest thing from judicial restraint. So according to this opinion, "judicial restraint" is to uphold judicial overreach. Word salad, indeed.

I don’t know how the man writes the word salad that he does and then winds up in concurrance with the other five in the majority. However his mental gymnastics in this current word salad further demonstrates the mixed up intellect that gave us Obamacare.

He misses Alito’s salient point - neither Casey nor Roe had any judicial basis for writing any ground rules about abortion, and stare decis or not how could you aknowldge that and then compromise as if you can merely modify standards that should not have been set by the court in the first place.

He also misses the most fundamental error of Roe - it aborgated the Constitution clear mandate that basic Constitutitional rights are written not by judges, created out of whole cloth, but by we the people through the processes of writing and formally amending the Constitution.

Nothing Roberts has ever said or written has impressed me in the least.

His “concurrence” is likely what delayed the publication of the opinion until the very end of the term.

He is the Bush family’s personal representative at SCOTUS.

Roberts is just Bushie scum.

Roberts has no credibility. He knew that there were 5 votes to uphold the Mississippi law, so he tried to steer the decision toward an uphold-but-save-Roe/Casey. The problems for him were several. He shot himself in the foot by voting with the liberals in the Louisiana abortion case (June Medical) two years ago. As such he has no credibility on this issue with the other conservatives on the court. And, finally, as Alito pointed out, if you uphold a 15-week ban, then a couple years from now, you’re going to find yourself ruling on a 14-week ban or 12-week ban. It never ends. So why not just get it over with and kick the issue back to the states?

If Merrick Garland had become a justice rather than Neil Gorsuch I have no doubt that Roberts would have voted with the liberals for a 5-4 loss for us.

I’m not sure conservatives should not pursue the impeachment of John Roberts

Liberals would vote for it and it would not greatly change the court voting pattern

It would send a powerful signal for Republican appointees to stop misleading about their ideology and consistently betraying the constitutional perspective.

Republicans have a good shot to gain the presidency in 2024.

Justice Roberts sucks. President GW who appointed Roberts, also sucks. I don’t recall SCOTUS exercising judicial restraint in 1973 when they turned the world on its head by creating a manufactured “rigth” to an abortion that is suggested nowhere in the text of the US Constitution.

Benedict Roberts is a complete and total, dismal failure. Without President Trump’s judicial appointments we would be so screwed.
